  AN ACT to amend the public health law, in relation  to  establishing  an
    opioid   addiction  treatment  and  hospital  diversion  demonstration
    program

    THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
  BLY, DO ENACT AS FOLLOWS:
Section 1. The public health law is amended by adding a new section 3309-b to read as follows:
S 3309-B. OPIOID ADDICTION TREATMENT AND HOSPITAL DIVERSION DEMON- STRATION PROGRAM. 1. THE COMMISSIONER, IN CONSULTATION WITH THE OFFICE OF ALCOHOLISM AND SUBSTANCE ABUSE SERVICES, SHALL, WITHIN THE AMOUNTS APPROPRIATED THEREFOR, ESTABLISH AN OPIOID ADDICTION TREATMENT AND HOSPITAL DIVERSION DEMONSTRATION PROGRAM. THIS PROGRAM SHALL PROVIDE A NEW MODEL OF DETOXIFICATION AND TRANSITIONAL SERVICES FOR INDIVIDUALS SEEKING TO RECOVER FROM OPIOID ADDICTION, THEREBY REDUCING RELIANCE ON EMERGENCY ROOM SERVICES. THE PROGRAM SHALL PROVIDE FOR THE TREATMENT OF PRESCRIPTION PAIN MEDICATION ADDICTION ON AN OUTPATIENT OR NON-MEDICAL RESIDENTIAL SHORT-TERM STAY BASIS. THE COMMISSIONER SHALL ESTABLISH UP TO SIX DEMONSTRATIONS THROUGHOUT THE STATE, AND AT MINIMUM A DEMON- STRATION SHALL BE ESTABLISHED IN EACH OF THE FOLLOWING AREAS: WESTERN NEW YORK, CENTRAL NEW YORK, STATEN ISLAND, BROOKLYN AND LONG ISLAND. 2. NOT LATER THAN TWO YEARS AFTER THE EFFECTIVE DATE OF THIS SECTION, THE COMMISSIONER SHALL PROVIDE THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE, THE SPEAKER OF THE ASSEMBLY, THE CHAIR OF THE SENATE STAND- ING COMMITTEE ON HEALTH AND THE CHAIR OF THE ASSEMBLY HEALTH COMMITTEE WITH A WRITTEN EVALUATION OF THE DEMONSTRATION PROGRAM. SUCH EVALUATION SHALL ADDRESS THE OVERALL EFFECTIVENESS OF THIS TREATMENT MODEL AS IT RELATES TO PATIENTS, THE SURROUNDING COMMUNITY, HEALTH CARE PROVIDERS AND HEALTH CARE PAYORS, AND SHALL INCLUDE, BUT NOT BE LIMITED TO, THE EFFECTIVENESS OF THE PROGRAM IN PROVIDING ACCESS TO SERVICES, THE IMPACT OF THESE SERVICES, THE ASSOCIATED COSTS SAVINGS, AND WHETHER THE EXPAN- SION OF THIS OR SIMILAR MODELS ARE RECOMMENDED.
