TITLE OF BILL:
An act
to amend the criminal procedure law, in relation to designating certain
officers or agents appointed by the Niagara county department of social
services as peace officers

PURPOSE OR GENERAL IDEA OF BILL:
This bill would allow officers and
agents appointed by the Niagara County Department of Social Services
to be granted Peace Officer Status

SUMMARY OF SPECIFIC PROVISIONS:
Section 1. Amends Section 2.10 of the
Criminal Procedure Law by adding a new subdivision 83. to allow
officers or agents appointed by the Niagara County Department of
Social Services to be granted Peace Officer Status.

JUSTIFICATION:
Currently, The Niagara County Sheriff's Department is
responsible for investigating and arresting individuals suspected of
welfare fraud and other offenses. Due to budgetary constraints the
Sheriff's department may not be able to continue in this function.
Since Welfare and Medicaid fraud in particular have negative fiscal
implications for Niagara County, it is vitally important that
Department of Social Services investigators be able to fill this role
as needed.
Allowing designated and qualified individuals to have Peace Officer
status will fulfill this need.

EFFECTIVE DATE:

  AN ACT to amend the criminal procedure law, in relation  to  designating
    certain  officers or agents appointed by the Niagara county department
    of social services as peace officers

    THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
  BLY, DO ENACT AS FOLLOWS:
Section 1. Section 2.10 of the criminal procedure law is amended by adding a new subdivision 83 to read as follows:
83. OFFICERS OR AGENTS APPOINTED BY THE NIAGARA COUNTY DEPARTMENT OF SOCIAL SERVICES WHO ARE AUTHORIZED TO INVESTIGATE AND ARREST PERSONS INVOLVED IN WELFARE FRAUD AND OTHER SIMILAR OFFENSES; PROVIDED, HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH OFFI- CER TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS THE APPRO- PRIATE LICENSE THEREFOR HAS BEEN ISSUED PURSUANT TO SECTION 400.00 OF THE PENAL LAW.
