BILL NUMBER:S4219 TITLE OF BILL: An act to prohibit the New York state department of health from reducing the reimbursement rates for the early intervention program below the rates in effect as of March 1, 2010 PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to prevent the NYS Department of Health from reducing the reimbursement rates for providers who provide services under the Early Intervention Program. SUMMARY OF PROVISIONS: Section 1 of the bill states that the NYS Department of Health shall not reduce the reimbursement rates for the Early Intervention Program established by section 2540 of the public health law below those reimbursement rates in effect as of March 1, 2010. Section 2 of the bill sets an immediate effective date and shall be deemed to have been in full force and effect on and after March 1, 2010. JUSTIFICATION: In April of 2010, the Commissioner of the NYS Department of Health, revised and reduced reimbursement rates for Early Intervention Providers (EIP); including but not limited to, speech therapists, physical therapists, occupational therapists, ABA teachers, social workers, physchologists, and other professionals without consideration by the NYS Legislature. Nearly, 75,000 children and families are served in the NYS Early Intervention Program each year. The impact of the reduction in provider rates has a direct correlation in the reduction in the numbers of children served with developmental disabilities. The passage of this bill will prevent the Commissioner of NYS Department of Health from reducing the reimbursement rates for Early Intervention Providers (EIP) without legislative action. PRIOR LEGISLATIVE HISTORY: Same As A.00705 (Weprin) FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: Unknown. EFFECTIVE DATE: This act shall take effect immediately and shall be deemed to have been in full force and effect on and after March 1, 2010.

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. The department of health shall not reduce the reimbursement rates for the Early Intervention Program established by section 2540 of the public health law below those reimbursement rates in effect as of March 1, 2010.
