TITLE OF BILL:
An act
to amend the tax law, in relation to extending the authorization of the
county of Rensselaer to impose an additional one percent of sales and
compensating use taxes

PURPOSE OR GENERAL IDEA OF BILL:
This legislation
authorizes the
imposition of an additional one percent sales tax in Rensselaer
County until November 30, 2013.

SUMMARY OF SPECIFIC PROVISIONS:
The bill amends clause 3 of
subparagraph (i) of the opening paragraph of section 1210 of the tax
law to authorize the continuation of an additional one percent sales
tax in Rensselaer County until November 30, 2013.

JUSTIFICATION:
This legislation is being introduced at the request of
the Rensselaer County Legislature. Under current law, Rensselaer
County is authorized to collect an additional one percent sales tax.
This is due to expire on November 30, 2011 (Chapter 125 of the Laws
of 2009). This legislation is necessary to allow Rensselaer County to
continue its collection of the additional sales tax.

PRIOR LEGISLATIVE HISTORY:

FISCAL IMPLICATIONS:
None to the State.

EFFECTIVE DATE:
Immediately.

CANESTRARI -- read once and referred to the Committee on Ways and Means AN ACT to amend the tax law, in relation to extending the authorization of the county of Rensselaer to impose an additional one percent of sales and compensating use taxes

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:


Section 1. Clause 3 of subparagraph (i) of the opening paragraph of section 1210 of the tax law, as amended by chapter 125 of the laws of 2009, is amended to read as follows:
(3) the county of Rensselaer is hereby further authorized and empowered to adopt and amend local laws, ordinances or resolutions imposing such taxes at a rate which is one percent additional to the three percent rate authorized above in this paragraph for such county for the period beginning September first, nineteen hundred ninety-four and ending November thirtieth, two thousand [eleven] THIRTEEN;
