TITLE OF BILL:
An act
to amend chapter 327 of the laws of 2006, amending the tax law relating
to authorizing the county of Essex to impose an additional mortgage
recording tax, in relation to extending the expiration and repeal of
such provisions

PURPOSE:
To extend from December 1, 2012 to December 1, 2015, the expiration of
the authorization to the county of Essex to impose an additional
mortgage recording tax

SUMMARY OF PROVISIONS:
Section 1. Amends Chapter 327 of the laws of 2006 to authorize the
county of Essex to impose an additional mortgage recording tax.

Section 2. Contains the effective date

EXISTING LAW:
Section 3 of chapter 327 of the laws of 2006 which granted Essex
County the authority to impose an additional mortgage recording tax
expires on December 1, 2012.

JUSTIFICATION:
The Essex County Board of Supervisors has requested the introduction
of legislation extending their authority to impose an additional
mortgage recording tax to December 1, 2015.

FISCAL IMPLICATIONS:
None to the State.

LOCAL FISCAL IMPLICATIONS:
Will continue to generate funds for Essex County.

EFFECTIVE DATE:
This act shall take effect immediately.

  AN ACT to amend chapter 327 of the laws of 2006, amending  the  tax  law
    relating  to  authorizing  the county of Essex to impose an additional
    mortgage recording tax, in relation to extending  the  expiration  and
    repeal of such provisions

    THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
  BLY, DO ENACT AS FOLLOWS:
Section 1. Section 3 of chapter 327 of the laws of 2006, amending the tax law relating to authorizing the county of Essex to impose an addi- tional mortgage recording tax, as amended by chapter 128 of the laws of 2009, is amended to read as follows:
S 3. This act shall take effect immediately; provided, however, that this act shall expire and be deemed repealed December 1, [2012] 2015. S 2. This act shall take effect immediately.
