TITLE OF BILL:
An act
to amend the public health law, in relation to requiring hospitals to
obtain the name of the school attended by school-aged
patients and to include this information in their
admission registration forms

PURPOSE OR GENERAL IDEA OF BILL:
This bill provides that hospital, medical clinics and private practice
physicians include a request for the school grade and name of the
school attended by their school-aged patients name and that this
information be included as part of the written vital patient data
collected prior to treatment and establishes a protocol for immediate
notification of the local department of health if said school-aged
child is diagnosed with an infectious and communicable disease.

SUMMARY OF SPECIFIC PROVISIONS:
This bill amends section 2805 of the public health law by adding a
subsection "t" to require hospitals, medical clinics and private
practice physicians to request, upon treatment of school-aged
patients, the grade and name of the school that said school-aged
patient attends and to include such inquiry in their patient records.
This bill further adds a new section 2113 to the public health law
establishing a protocol for the immediate notification of the local
department of health, if said school-aged child is diagnosed with an
infectious and communicable disease, to facilitate the immediate
initiation of inspection and additional notification protocols as
soon as practicable.

JUSTIFICATION:
The recent death of 12 year-old Omar Rivera, who attended 1.S. 211 in
Canarsie, Brooklyn, from the methicillin-resistant Staphylococcus
aureus, commonly known as MRSA and the increasing number of reported
infected youth across the state, highlighted the need for health
practitioners to be more responsive alerting the affected community
as to their exposure and the preventative measures they must
immediately take.
By requiring hospitals, medical clinics and private practice
physicians who treat infected school-age children to ascertain the
school locality of exposure and potential infection at the time of
admission and to
promptly pass this information on to the local department of health,
this legislation will effectively help to reduce the possibility of
long-term exposure and infection within the affected school locality
as well as in the community in general.

AN ACT to amend the public health law, in relation to  requiring  hospi
 tals to obtain the name of the school attended by school-aged patients

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM
 BLY, DO ENACT AS FOLLOWS:

 

Section 1.  The public health law is amended by adding a  new  section
 230-e to read as follows:

 

S  230-E. REGISTRATION REQUIREMENTS. EVERY PHYSICIAN SHALL INQUIRE AND
 DOCUMENT AS PART OF HIS  OR  HER  PATIENT  REGISTRATION,  THE  NAME  AND
 ADDRESS  OF THE SCHOOL ATTENDED BY SUCH PHYSICIAN'S SCHOOL-AGED PATIENTS
 AND INCLUDE SUCH INFORMATION IN THE PATIENTS' MEDICAL REGISTRATION FORM.
 

S 2. The public health law is amended by adding a new  section  2805-u
 to read as follows:

 

S  2805-U.  ADMISSION  REGISTRATION  REQUIREMENTS. ALL HOSPITALS SHALL
 INQUIRE AND DOCUMENT THE NAME AND ADDRESS  OF  THE  SCHOOL  ATTENDED  BY
 SCHOOL-AGED PATIENTS UPON ADMISSION, AND INCLUDE SUCH INFORMATION ON THE
 HOSPITALS' ADMISSION REGISTRATION FORM.
 

S  3. The public health law is amended by adding a new section 2113 to
 read as follows:

 

S 2113. INFECTIOUS AND COMMUNICABLE DISEASE; NOTIFICATION PROTOCOL FOR
 SCHOOL-AGED CHILDREN. NOTWITHSTANDING SECTION TWENTY-ONE HUNDRED TEN  OF
 THIS  TITLE, THIS SECTION SHALL APPLY TO A CITY WITH A POPULATION OF ONE
 MILLION OR MORE. 1. WHERE A SCHOOL-AGED PATIENT IS REGISTERED FOR TREAT
 MENT, ADMITTED WITH AN INFECTIOUS OR COMMUNICABLE  DISEASE  OR  ADMITTED
 FOR  OBSERVATION TO RULE OUT AN INFECTIOUS OR COMMUNICABLE DISEASE, SUCH
 HOSPITAL SHALL NOTIFY THE LOCAL  DEPARTMENT  OF  HEALTH  IMMEDIATELY  AS
 REQUIRED BY SECTION TWENTY-ONE HUNDRED ONE OF THIS TITLE. IN A CITY WITH
 A POPULATION OF ONE MILLION OR MORE, HOSPITALS SHALL CONTACT THE DEPART
 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
 [ ] is old law to be omitted.

 MENT OF HEALTH AND MENTAL HYGIENE TO INITIATE THE INSPECTION PROVIDED IN
 SECTION 17-106 OF THE ADMINISTRATIVE CODE OF THE CITY OF NEW YORK.
 2.  THE LOCAL DEPARTMENT OF HEALTH, AND IN A CITY WITH A POPULATION OF
 ONE MILLION OR MORE THE DEPARTMENT OF HEALTH AND MENTAL  HYGIENE,  SHALL
 IN  CONSULTATION  WITH  THE STATE DEPARTMENT OF HEALTH NOTIFY THE SCHOOL
 ATTENDED BY SUCH PATIENT AS SOON AS PRACTICABLE.
 3. THE SCHOOL  SHALL  IMMEDIATELY  FOLLOW  THE  NOTIFICATION  PROTOCOL
 DEEMED  NECESSARY BY THE STATE DEPARTMENT OF HEALTH, OR IN A CITY WITH A
 POPULATION OF ONE MILLION OR MORE BY THE DEPARTMENT OF HEALTH AND MENTAL
 HYGIENE, IN NOTIFYING THE STUDENTS AND PARENTS OF SUCH SCHOOL.
 

S 4. Subdivision 1 of section 2101 of the public health law is amended
 to read as follows:

 1. Every physician shall immediately give  notice  of  every  case  of
 communicable disease required by the department to be reported to it, to
 the  health  officer  of  the  local  health district where such disease
 occurs. WHERE SUCH CASE  INVOLVES  A  SCHOOL-AGED  PATIENT,  SUCH  LOCAL
 HEALTH OFFICER SHALL IN CONSULTATION WITH THE STATE DEPARTMENT OF HEALTH
 NOTIFY  THE  SCHOOL  ATTENDED BY SUCH PATIENT AS SOON AS PRACTICABLE AND
 SUCH SCHOOL SHALL IMMEDIATELY FOLLOW THE STUDENT AND PARENT NOTIFICATION
 PROTOCOL, AS REFERENCED  IN  SUBDIVISION  THREE  OF  SECTION  TWENTY-ONE
 HUNDRED  THIRTEEN  OF  THIS  TITLE.  NOTWITHSTANDING  SECTION TWENTY-ONE
 HUNDRED TEN OF THIS TITLE, THIS SUBDIVISION SHALL APPLY TO A CITY WITH A
 POPULATION OF ONE MILLION OR MORE.
 

S 5. This act shall take effect immediately.
