BILL NUMBER:S7239

TITLE OF BILL:
An act
to amend the education law, in relation to state aid to libraries and
library systems

PURPOSE:
This bill would eliminate the financial disincentive under the current
state aid formulas for the merging of library systems.

SUMMARY OF PROVISIONS:
Section 1 of the bill adds a new paragraph (o) to 273(1) Education Law
to provide that any new public library system established through
merger on or after April 1, 2012 shall continue to receive at least
the same level of funding annually as the component systems would
have received individually as of the fiscal year immediately
preceeding the year in which the merger was approved.

Section 2 of the bill adds a new paragraph (d) to 273(4) Education Law
to provide that any new reference and research library resources
system established through merger on or after April 1, 2012 shall
continue to receive at least the same level of funding annually as
the component systems would have received individually as of the
fiscal year immediately preceeding the year in which the merger was
approved.

JUSTIFICATION:
New York currently has 23 public library systems and 9 reference and
research library systems which provide a variety of services to
numerous local libraries. These systems play an important role in
ensuring the availability of library services throughout the State,
and work closely with local libraries to assist them with their
needs. Some systems have considered the possibility of merging in
order to operate more efficiently and effectively and to retain or
expand their services.
However, under the current state aid formulas, systems which merge
would receive less state aid than the component systems would receive
if they remained separate entities. This bill would preserve current
levels of state aid for library systems that merge, thereby
eliminating a potential financial disincentive for such mergers.

FISCAL IMPLICATIONS:
None to the State, as merged systems would
continue to receive the same level of state aid as the component
systems had received separately.

EFFECTIVE DATE:
Immediately.

AN ACT to amend the education law, in relation to state aid to libraries and library systems THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:


Section 1. Subdivision 1 of section 273 of the education law is amended by adding a new paragraph o to read as follows:
O. ANY NEW PUBLIC LIBRARY SYSTEM ESTABLISHED THROUGH MERGER ON OR AFTER APRIL FIRST, TWO THOUSAND TWELVE, SHALL RECEIVE NO LESS STATE FORMULA AID THAN THE COMPONENT PUBLIC LIBRARY SYSTEMS WERE ENTITLED TO RECEIVE UNDER THIS SECTION AND SECTIONS TWO HUNDRED SEVENTY-TWO AND TWO HUNDRED EIGHTY-FIVE OF THIS PART IN THE FISCAL YEAR IMMEDIATELY PRECEED ING THE YEAR IN WHICH SUCH MERGER IS APPROVED BY THE COMMISSIONER.

ANY NEW REFERENCE AND RESEARCH LIBRARY RESOURCES SYSTEM ESTABLISHED THROUGH MERGER ON OR AFTER APRIL FIRST, TWO THOUSAND TWELVE, SHALL RECEIVE NO LESS STATE FORMULA AID THAN THE COMPONENT REFERENCE AND RESEARCH LIBRARY RESOURCES SYSTEMS WERE ENTITLED TO RECEIVE UNDER THIS SECTION AND SECTION TWO HUNDRED SEVENTY-TWO OF THIS PART IN THE FISCAL YEAR IMMEDIATELY PRECEDING THE YEAR IN WHICH SUCH MERGER IS APPROVED BY THE COMMISSIONER.
