TITLE OF BILL:
An act
to amend the insurance law, in relation to insuring motor vehicles used
for volunteer firefighting

PURPOSE:
This legislation prohibits insurance companies from refusing
to issue or renew an automobile insurance policy for the sole reason
that the motor vehicle to be insured is used for volunteer fire
fighting.

SUMMARY OF PROVISIONS:
Section 3425 of the insurance law is amended by
adding a new subsection (s) to prohibit insurance companies
from refusing to issue or renew an automobile insurance individually
owned private passenger policy for the sole reason that the motor
vehicle to be insured is used for volunteer fire fighting.

JUSTIFICATION:
A major auto insurance company serving New York
residents recently denied renewal of an auto insurance policy for a
gentleman for the sole reason that he used the vehicle to travel to
calls in his role as a volunteer fire fighter.

Members of volunteer fire departments across New York State
consistently serve the needs of the citizens and their guests with
bravery and honor. Yet, time restraints and the cost of living have
made it very hard to recruit and retain membership in the Volunteer
Fire Departments. It is already difficult to find individuals with
the time to join and as a result the last thing our volunteer fire
departments need is another deterrent to join or remain involved in
volunteer service.

This legislation guarantees when a person makes the positive decision
to serve his or her community in the ranks of their volunteer fire
department, they will not face a loss of auto insurance. Valiant
service protecting life and property is worthy of such protection.

  AN  ACT  to amend the insurance law, in relation to insuring motor vehi-

    THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
  BLY, DO ENACT AS FOLLOWS:
Section 1. Section 3425 of the insurance law is amended by adding a new subsection (s) to read as follows:
(S) WITH RESPECT TO AUTOMOBILE INSURANCE, NO INSURER SHALL REFUSE TO ISSUE OR RENEW A COVERED INDIVIDUALLY-OWNED PRIVATE PASSENGER POLICY SOLELY ON THE GROUND THAT THE MOTOR VEHICLE TO BE INSURED UNDER SUCH POLICY SHALL BE USED FOR VOLUNTEER FIREFIGHTING.
