THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. The penal law is amended by adding a new section 240.38 to read as follows:
S 240.38 AGGRAVATED DISORDERLY CONDUCT. A PERSON IS GUILTY OF AGGRAVATED DISORDERLY CONDUCT WHEN AFTER HAVING BEEN CONVICTED OF THE VIOLATION OF SECTION 240.20 OF THIS ARTICLE ON SIX OR MORE OCCASIONS WITHIN THE PREVIOUS YEAR OR ON TEN OR MORE OCCASIONS WITHIN THE PREVIOUS TWO YEARS. AGGRAVATED DISORDERLY CONDUCT IS A CLASS A MISDEMEANOR.
S 2. This act shall take effect on the first of November next succeed ing the date on which it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD01819-01-1
