Section 1.
Section 104 of the executive law is amended to read as follows:
S 104. Departmental cooperation. (A) The secretary of state may advise with the several departments, boards, bureaus, officers, authorities, commissions and other agencies of the state which are authorized by statute to issue codes, rules or regulations, to the end that the same may, so far as possible, be uniform in style and form, be properly numbered and captioned and be free from matter which is obsolete. (B) THE SECRETARY OF STATE SHALL, IN CONSULTATION WITH THE COMMISSION ER OF HEALTH, ADVISE WITH STATE DEPARTMENTS, BOARDS, BUREAUS, AUTHORI TIES, COMMISSIONS, DIVISIONS AND OTHER AGENCIES WITH PUBLIC WEBSITES THAT HAVE SIGNIFICANT PUBLIC INTERACTION TO ENSURE THAT EACH CREATES A LINK ON THEIR HOMEPAGE TO HEALTH CARE PROXY INFORMATION ON THE DEPART MENT OF HEALTH WEBSITE. A STATE DEPARTMENT, BOARD, BUREAU, AUTHORITY, COMMISSION, DIVISION AND AGENCY WHICH DETERMINES THAT THEY DO NOT HAVE SIGNIFICANT PUBLIC TRAFFIC ON THEIR WEBSITE, OR WHICH DETERMINES THAT CREATING SUCH A LINK WOULD BE A FINANCIAL HARDSHIP, MAY BE EXEMPTED FROM THE PROVISIONS OF THIS SUBDIVISION.
