AN ACT to amend the general business law, in relation to the disposal of bedding
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. The general business law is amended by adding a new section 389-d to read as follows:
S 389-D. DISPOSAL OF BEDDING. 1. EACH PIECE OF BEDDING SHALL BE ENCLOSED IN A PROTECTIVE CONTAINER PRIOR TO ITS REMOVAL FROM A PREMISES WHERE IT WAS USED AND DURING ITS DISPOSAL; PROVIDED, HOWEVER, THAT THE PROVISIONS OF THIS SUBDIVISION SHALL NOT APPLY TO ANY MATTRESS WITHIN A CITY HAVING A POPULATION OF ONE MILLION OR MORE. 2. AS USED IN THIS SECTION, "PROTECTIVE CONTAINER" MEANS ANY PROTEC TIVE DEVICE, MATERIAL, OBJECT OR COVERING WHICH FULLY ENCASES OR WRAPS BEDDING. 3. ANY VIOLATION OF THIS SECTION SHALL BE PUNISHABLE BY A CIVIL PENAL TY OF ONE HUNDRED DOLLARS PAYABLE TO THE DEPARTMENT OF STATE.
