TITLE OF BILL:
An act
to amend the New York state printing and public documents law and
the state technology law, in
relation to agency reports

PURPOSE:
To eliminate excessive paperwork while ensuring that state
legislators and legislative staff have access, via the Internet, to
important state agency publications.

SUMMARY OF PROVISIONS:
Section 1 -- Amends subdivision 4 of section 12 of the New York State
printing and public Documents Law. Establishes that when a report is
required to be created by a state agency, the agency must notify the
appropriate legislative offices that the document will be posted on
the New York State Agency Documents Website.

Section 2 -- Amends section 103 of the State Technology Law to create
the New York State Agency Documents website. This web-based database
will allow state legislators, legislative staff members, and the
public to have access to all reports that are required, by
legislation, to be created.

Section 3 -- Effective date.

JUSTIFICATION:
In 2005, the state Legislature passed and the Governor signed into law
the Reporting Requirement Reform Act. This act corrected some
significant deficiencies in the way reports by agencies are submitted
to the state Legislature. The Reporting Requirement Reform Act
simplified reporting requirements and at the same time eliminated
unnecessary reporting requirements. This bill seeks to build upon and
enhance the Reporting Requirement Reform Act by further eliminating
unneeded printed documents.
Under this bill, reporting requirements by state agencies will be
fulfilled by posting those reports on the Internet at the New York
State Agency Documents Website (which is established by section 2 of
this bill). This legislation, however, allows members of the State
Legislature who are still uncomfortable with the Internet to request
a printed copy of their desired report.

FISCAL IMPLICATIONS:
Unable to determine. However, New York State is likely to save some
amount due to reduced printing costs.


EFFECTIVE DATE:
This act shall take effect on the one hundred twentieth day after it
shall have become a law.

AN ACT to amend the New York state printing and public documents law and
 the state technology law, in relation to agency reports
 THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM
 BLY, DO ENACT AS FOLLOWS:

 

Section  1. Subdivision 4 of section 12 of the New York state printing
 and public documents law, as added by chapter 524 of the laws  of  2005,
 is amended to read as follows:

 4.  (a)  Whenever  state  law  requires a state agency to make, issue,
 submit, deliver, distribute or forward a report to the "legislature"  or
 to  "members of the legislature" or to "both houses of the legislature,"
 or to any particular legislative officers or chairpersons of legislative
 committees, subcommittees or commissions, the agency shall satisfy  such
 requirement by [either]:

 (i) [making, issuing, submitting, delivering, distributing or forward-
 ing  a  printed copy of the report to each member of the legislature, or
 to the specified legislative officers or chairpersons, as the  case  may
 be;  or]  MAKING  SUCH  DOCUMENT  AVAILABLE ON THE NEW YORK STATE AGENCY
 DOCUMENTS WEBSITE, AS AUTHORIZED BY SUBDIVISION EIGHTEEN OF SECTION  ONE
 HUNDRED  THREE  OF THE STATE TECHNOLOGY LAW, UNDER THE APPROPRIATE AGEN
 CY'S HEADING AND SENDING A PRINTED LETTER OR NOTICE TO  EACH  MEMBER  OF
 THE  LEGISLATURE,  OR  TO  THE  SPECIFIED LEGISLATIVE OFFICERS OR CHAIR
 PERSONS, AS THE CASE MAY BE, INDICATING THE AVAILABILITY OF SUCH  REPORT
 ON THIS WEBSITE; AND BY
 (ii)  making  such  document  available  on  its website and sending a
 printed letter or notice to each member of the legislature,  or  to  the
 specified  legislative  officers  or  chairpersons,  as the case may be,
 indicating the availability of such report on the agency's website.
 (b) Such letter or notice shall  include  the  name  of  the  specific
 report,  the specific web address at which the report can be accessed or

 [ ] is old law to be omitted.

 instructions on how to access the report from the agency's homepage, and
 the name of the person at the state agency to whom  the  legislator  may
 direct a request to obtain a printed copy of the report, free of charge,
 if so desired.

Section  103 of the state technology law is amended by adding a
 new subdivision 18 to read as follows:

 18. TO ESTABLISH, ADMINISTER AND MAINTAIN  A  NEW  YORK  STATE  AGENCY
 DOCUMENTS  WEBSITE  WHICH WILL INCLUDE POSTINGS OF ALL REPORTS ISSUED BY
 STATE AGENCIES, DEPARTMENTS, PUBLIC AUTHORITIES, PUBLIC  BENEFIT  CORPO
 RATIONS  OR ENTITIES WHENEVER STATE LAW REQUIRES A STATE AGENCY TO MAKE,
 ISSUE, SUBMIT, DELIVER, DISTRIBUTE OR FORWARD A REPORT TO THE  "LEGISLA
 TURE"  OR  TO  "MEMBERS  OF  THE  LEGISLATURE" OR TO "BOTH HOUSES OF THE
 LEGISLATURE", OR TO ANY PARTICULAR LEGISLATIVE OFFICERS OR  CHAIRPERSONS
 OF LEGISLATIVE COMMITTEES, SUBCOMMITTEES OR COMMISSIONS. IT SHALL BE THE
 RESPONSIBILITY  OF  THE NEW YORK STATE AGENCY DOCUMENTS WEBSITE TO SERVE
 AS THE CENTRAL REPOSITORY FOR THE POSTING AND ARCHIVING OF ALL DOCUMENTS
 PROVIDED TO THE LEGISLATURE AS REQUIRED BY STATE LAW.
 

S 3. This act shall take effect on the one hundred twentieth day after
 it shall have become a law.
