BILL NUMBER:S5765A TITLE OF BILL: An act relating to permitting the continued use of certain outdoor advertising signs PURPOSE: To allow an outdoor advertising sign which had been damaged by a storm and reconstructed in 2006 to remain in existence. SUMMARY OF PROVISIONS: This bill provides that an outdoor advertising sign shall be allowed to continue to exist if it was lawfully in existence prior to September 1, 1965, is located in Montgomery County, is visible from the Thruway, and was damaged by bad weather and rebuilt prior to January 1, 2007. However, section 2 of the bill provides that this act shall be repealed if any federal agency or any court of competent jurisdiction determines that this act would render New York State ineligible for the receipt of federal funds. JUSTIFICATION: In 2006, bad weather damaged an outdoor advertising sign in Montgomery County near the New York State Thruway. Although the sign was allowed to be reconstructed, at significant cost, the Department subsequently indicated that the sign would need to be removed at the conclusion of a five-year period in 2012. This bill would create a limited exception that would enable this particular sign to remain in existence. Not only did the affected business invest a significant amount into rebuilding the sign, this sign has long served as an important notice of lodging in the Fulton County area, helping to promote tourism in the region. FISCAL IMPLICATIONS: None. EFFECTIVE DATE: Immediately, provided that DOT shall notify the Legislative Bill Drafting Commission upon the occurrence of events resulting in the repeal of this act.

AN ACT relating to permitting the continued use of certain outdoor
advertising signs
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Notwithstanding the provisions of section 88 of the highway
law, or any regulations adopted pursuant to such law, an outdoor adver-
tising sign shall be allowed to continue to exist if such sign: (i) was
lawfully in existence prior to September 1, 1965; (ii) is located in
Montgomery county and is visible from the New York State Thruway; and
(iii) was damaged by bad weather and rebuilt prior to January 1, 2007.
S 2. This act shall be deemed repealed if any federal agency or any
court of competent jurisdiction determines that this act would render
New York state ineligible for the receipt of federal funds.
S 3. This act shall take effect immediately; provided, however, that
the commissioner of the department of transportation shall notify the
legislative bill drafting commission upon the occurrence of the
provisions of section two of this act in order that the commission may
maintain an accurate data base of the official text of the laws of the
state of New York in furtherance of effecting the provisions of section
44 of the legislative law and section 70-b of the public officers law.
