BILL NUMBER:S7060 TITLE OF BILL: An act to amend the public health law, in relation to electronic prescriptions for controlled substances PURPOSE: This bill allows for electronic prescribing of controlled substances, in order to keep more accurate records of those with these prescriptions. SUMMARY OF PROVISIONS: Section 1 states that this act shall be known as the Michael David Israel Electronic Prescription Act. Section 2 amends subdivision 1, section 3332 of the public health law by allowing schedule I, II, III, IV, and V controlled substances to be prescribed electronically. JUSTIFICATION: Currently, controlled substances cannot be prescribed electronically. Abuse of prescription drugs has risen dramatically throughout New York state and, given the increasing demand to procure these drugs, the physical prescription pads used to prescribe these controlled substances are now more than ever at risk for theft and misuse. This bill will allow physicians and nurse practitioners to electronically prescribe controlled substances, sending the prescription directly to the pharmacy, making the system safer and more secure. Michael David Israel was a young man from Western New York who took his own life on June 4, 2011, due to his battle with prescription drug addiction. This bill is named after him to recognize not only his struggle but the struggle that thousands of New Yorkers face on a daily basis. LEGISLATIVE HISTORY: New bill. FISCAL IMPLICATIONS: None. EFFECTIVE DATE: This act shall take effect immediately.

AN ACT to amend the public health law, in relation to electronic prescriptions for controlled substances
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. This act shall be known and may be cited as the "Michael David Israel electronic prescription act".
S 2. Subdivision 1 of section 3332 of the public health law, as amended by chapter 178 of the laws of 2010, is amended to read as follows:
1. No controlled substance may be prescribed by a practitioner except THAT SCHEDULE I, II, III, IV AND V CONTROLLED SUBSTANCES MAY BE PRESCRIBED on an official New York state prescription or on an electron ic prescription, and in good faith and in the course of his or her professional practice only.
