BILL NUMBER:S7185 TITLE OF BILL: An act to amend the election law, in relation to hours for voting PURPOSE OR GENERAL IDEA OF BILL: On the occasion that a special election be held on the same date as a primary election, all poll locations within the political subdivision of the special election shall be open from six o'clock in the morning until nine o'clock at night for all voting. SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends section 8-100 of the election law, which prescribes dates of and hours for voting. Section 2 contains the effective date. JUSTIFICATION: The current law is inconvenient and confusing to voters and requires excess expense to the taxpayers to accommodate the inconsistency in voting times. PRIOR LEGISLATIVE HISTORY: New bill. FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None. EFFECTIVE DATE: This act shall take effect immediately.

AN ACT to amend the election law, in relation to hours for voting
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The opening paragraph of subdivision 2 of section 8-100 of
the election law is designated paragraph (a) and a new paragraph (b) is
added to read as follows:
(B) NOTWITHSTANDING PARAGRAPH (A) OF THIS SUBDIVISION, IF A SPECIAL
ELECTION IS HELD ON THE SAME DATE AS A PRIMARY ELECTION, ANY POLL
LOCATED WITHIN THE POLITICAL SUBDIVISION OF THE SPECIAL ELECTION SHALL
BE OPEN FROM SIX O'CLOCK IN THE MORNING UNTIL NINE O'CLOCK AT NIGHT FOR
ALL VOTING, REGARDLESS IF IT IS FOR THE PRIMARY ELECTION OR THE SPECIAL
ELECTION.
S 2. This act shall take effect immediately.
