BILL NUMBER:S7418 TITLE OF BILL: An act in relation to the date of primary elections; and providing for the repeal of such provisions upon the expiration thereof PURPOSE: To provide that the 2012 primary election be held on the thirteenth of September. SUMMARY OF PROVISIONS: Section 1 of the bill provides that the 2012 primary election shall be held on September 13, 2012. Section 2 of the bill is the effective date. JUSTIFICATION: New York State Election Law �8-100(1)(a) prescribes that the fall primary shall be held on the first Tuesday after the second Monday in September before each general election. The 2012 fall primary election is scheduled for September 11, 2012. This legislation recognizes and respects the significance of the anniversary of the 9/11/O1 attacks by rescheduling the 2012 fall primary for September 13, 2012. LEGISLATIVE HISTORY: Similar to Ch. 49 of 2007 (A.8129 Silver/S.5755 Bruno) FISCAL IMPLICATIONS: None. EFFECTIVE DATE: This act shall take effect immediately and shall expire December 31, 2012.

AN ACT in relation to the date of primary elections; and providing for
the repeal of such provisions upon the expiration thereof
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Notwithstanding the provisions of paragraph (a) of subdi-
vision 1 of section 8-100 of the election law, the 2012 primary election
shall be held on September 13, 2012.
S 2. This act shall take effect immediately and shall expire December
31, 2012 when upon such date the provisions of this act shall be deemed
repealed.
