BILL NUMBER:S7524 TITLE OF BILL: An act to amend the public authorities law, in relation to the composition of the Niagara Frontier transportation authority PURPOSE: Technical amendment to clarify the composition of the Niagara Frontier Transportation Authority as proposed in S.6536 SUMMARY OF PROVISIONS: Amends paragraph c of subdivision 1 of section 1299-c as proposed in S.6536. JUSTIFICATION: Under current law, the NFTA Board of Commissioners consists of one chairman, ten voting members, and one non-voting member representing the Authority's largest labor organization. All members are recommended to, and appointed by, the governor with the advice and consent of the State Senate. The existing appointment process allows the governor to appoint board members, excluding the non-voting labor member, from any group or constituency. The addition of a member of the region's transit dependent community and/or people with disabilities will facilitate their input and result in better public service. The transit dependent community and people with disabilities represent a significant percentage of the NFTA Metro ridership base. The appointment of this member will ensure that their interests are properly represented and taken into consideration by the board. This member would also provide real time input from those constituencies and help the NFTA best serve and connect with riders. LEGISLATIVE HISTORY: New Bill. FISCAL IMPLICATIONS: None to State. EFFECTIVE DATE: Immediately.

AN ACT to amend the public authorities law, in relation to the composi tion of the Niagara Frontier transportation authority
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Paragraph (c) of subdivision 1 of section 1299-c of the public authorities law, as added by a chapter of the laws of 2012 amend ing the public authorities law relating to the composition of the Niagara Frontier transportation authority, as proposed in legislative bills numbers S. 6536 and A. 9455, is amended to read as follows:
(c) There shall also be a second non-voting member of the authority, who shall not be considered in determining a quorum. The second non-vot ing member shall be appointed by the governor as a representative of the transit dependent COMMUNITY and/or [disabled community] PEOPLE WITH DISABILITIES. The second non-voting member shall be appointed for a term of five years. [The chair of the authority, at his or her discretion,may exclude such non-voting member from attending any portion of a meet-ing of the authority or of any committee held pursuant to the executivesession provisions of the open meetings law.]
S 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2012, as proposed in legislative bills numbers S. 6536 and A. 9455, takes effect. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD16094-01-2
