BILL NUMBER:S764 TITLE OF BILL: An act to amend the highway law, in relation to permitting two or more towns to jointly purchase highway equipment PURPOSE: The purpose of this legislation is to allow two or more towns to jointly purchase and store highway equipment. SUMMARY OF PROVISIONS: Section 142 of the Highway Law is amended by adding a new subdivision 6 to allow two or more contiguous towns to purchase and provide for storage of highway equipment. JUSTIFICATION: Current law mandates that towns purchase and store their own highway equipment. This legislation would allow two or more towns and any villages contained partially or wholly within said towns, to consolidate services and save taxpayer's dollars by sharing the costs associated with the purchasing and storing of highway equipment. LEGISLATIVE HISTORY: 2009-2010: S.3417 - Passed Senate 2007-2008: S.365 - Passed Senate 2006: S.7925/A.11345 - Passed Senate FISCAL IMPLICATIONS: This bill would provide towns and some villages with the opportunity to save money by jointly purchasing and storing highway equipment. EFFECTIVE DATE: Immediately.

AN ACT to amend the highway law, in relation to permitting two or more
towns to jointly purchase highway equipment
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 142 of the highway law is amended by adding a new
subdivision 6 to read as follows:
6. A. TWO OR MORE CONTIGUOUS TOWNS MAY, UPON THE REQUEST OF THE HIGH-
WAY SUPERINTENDENTS OF SUCH TOWNS AND BY A MAJORITY VOTE OF EACH OF THE
TOWN BOARDS OF SUCH TWO OR MORE CONTIGUOUS TOWNS AUTHORIZE THE HIGHWAY
SUPERINTENDENTS OF SUCH TOWNS TO PURCHASE AND PROVIDE FOR STORAGE OF
HIGHWAY EQUIPMENT AS PROVIDED IN THIS SECTION.
B. EACH TOWN THAT SO ELECTS TO PARTICIPATE SHALL BY RESOLUTION OF THE
TOWN BOARD AUTHORIZE EXPENDITURE OF FUNDS FOR THE PURPOSE OF JOINT
PURCHASE AND USE OF HIGHWAY EQUIPMENT.
C. NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, A VILLAGE
PARTIALLY OR WHOLLY CONTAINED WITHIN A TOWN THAT PARTICIPATES IN A JOINT
HIGHWAY EQUIPMENT PURCHASE SHALL NOT BE REQUIRED BUT MAY, BY RESOLUTION
OF THE VILLAGE BOARD, ELECT TO PARTICIPATE IN A JOINT TOWN PURCHASE OF
HIGHWAY EQUIPMENT.
S 2. This act shall take effect immediately.
