I\n\n         9       want to recognize their principal, John\n\n        10       Capozzi.  I want to recognize their coach,\n\n        11       George Holub, who has molded this team into a\n\n        12       county championship.  And I want to recognize\n\n        13       the fact that for Elmont and Elmont High\n\n        14       School, this is their first county\n\n        15       championship in the history of that school.\n\n        16                  And it is well deserved.  The\n\n        17       Elmont Spartans beat the Baldwin Bruins 32-29\n\n        18       in the championship game.  And as a result of\n\n        19       that victory, my colleague and good friend\n\n        20       Senator Fuschillo will be joining us for lunch\n\n        21       in Elmont, at the high school, where we will\n\n        22       celebrate the victory of the Elmont Boys\n\n        23       Basketball Team.\n\n        24                  But to speak of this team in\n\n        25       particular -- and I think it's important that\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1530\n\n\n\n         1       we do that -- it's not just about the sports,\n\n         2       it's not just about the sports program and the\n\n         3       impact in the school, but these young men are\n\n         4       leaders in the Elmont community.  They\n\n         5       volunteer, they tutor, they mentor other\n\n         6       children, they're involved in not-for-profit\n\n         7       organizations, and they are making a\n\n         8       difference.  And they will make a difference\n\n         9       as future leaders in the Elmont community.\n\n        10                  And it is for that reason as well\n\n        11       as their great achievements on the basketball\n\n        12       court that I rise today and support and ask\n\n        13       that we all recognize such a great team and\n\n        14       this wonderful achievement.\n\n        15                  Mr. President, thank you.\n\n        16                  ACTING PRESIDENT O'MARA:    Thank\n\n        17       you, Senator Martins.\n\n        18                  Senator Fuschillo.\n\n        19                  SENATOR FUSCHILLO:    Thank you\n\n        20       very much, Mr. President.  I rise in a humbled\n\n        21       fashion here today that I do have to go to\n\n        22       Elmont High School and eat in their cafeteria\n\n        23       with the winning team.\n\n        24                  Senator Skelos and I represent\n\n        25       Baldwin, but he also represents Elmont as\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1531\n\n\n\n         1       well.  And despite the fact that Elmont beat\n\n         2       my son's basketball team at Merrick Calhoun\n\n         3       High School twice, and despite the fact that\n\n         4       they beat Baldwin in the championship, I just\n\n         5       wanted to rise and congratulate Senator\n\n         6       Martins and the fine group of the boys that\n\n         7       displayed a tremendous amount of character in\n\n         8       their victory.\n\n         9                  Congratulations, Elmont.\n\n        10                  ACTING PRESIDENT O'MARA:    I hope\n\n        11       you enjoy your lunch.\n\n        12                  (Laughter.)\n\n        13                  ACTING PRESIDENT O'MARA:    Senator\n\n        14       Skelos.\n\n        15                  SENATOR SKELOS:    Thank you very\n\n        16       much, Mr. President.\n\n        17                  I too want to congratulate the\n\n        18       Elmont Basketball Team. And generally when you\n\n        23       represent both, one of them is a winner. and be\n\n        19       it further\n\n        20                  \"RESOLVED, That a copy of this\n\n        21       resolution, suitably engrossed, be transmitted\n\n        22       to the New York Aviation Management\n\n        23       Association.\"\n\n        24                  ACTING PRESIDENT O'MARA:    Senator\n\n        25       Larkin on the resolution.\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1538\n\n\n\n         1                  SENATOR LARKIN:    Thank you very\n\n         2       much, Mr. President.\n\n         3                  You know, normally we don't\n\n         4       recognize a lot of people in the gallery\n\n         5       unless they're some sports teams or academic,\n\n         6       but we have some people in the gallery who've\n\n         7       made revenue for the State of New York.\n\n         8                  I'd like to introduce Carl\n\n         9       Beardsley, from Senator Libous's district, who\n\n        10       is the president of this organization, who's\n\n        11       been a driving force.  Carl, thank you very\n\n        12       much.\n\n        13                  And from my own district, although\n\n        14       he's a naval officer, I'll say Fritz Kass --\n\n        15       where are you hiding?  No hat on, I don't\n\n        16       recognize you.  And the other representatives\n\n        17       here of the airports throughout the state.\n\n        18                  You have made a major effort to\n\n        19       assist us in the development of our airports,\n\n        20       the area surrounding it, and the community, to\n\n        21       increase job opportunities.  We've been\n\n        22       slacking in many areas in this.  A couple of\n\n        23       years ago we did one with reference to the\n\n        24       taxes on what you would do with an airplane\n\n        25       when it needs to be repaired.  Instead of\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1539\n\n\n\n         1       sending it to, in my area, over to Shirley,\n\n         2       Connecticut, because of the taxes that we did\n\n         3       back in '07 you were able to take that tax\n\n         4       benefit here.\n\n         5                  We need to do a lot more of that,\n\n         6       because a lot of our small airports can make a\n\n         7       major contribution to the economy.  I know\n\n         8       what Cessna does for us at Stewart and all the\n\n         9       rest around the area.\n\n        10                  I just want to thank you all very\n\n        11       much for taking time from your busy schedule\n\n        12       to be here with us today and let my fellow\n\n        13       colleagues understand what the issue is with\n\n        14       regard to small aviation in our state. And I'm very proud to stand\n\n        24       here, as Carl Beardsley represents the Greater\n\n        25       Binghamton Airport -- or, as we like to refer\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1540\n\n\n\n         1       to it back home, as the Broome County Airport.\n\n         2       Some of us can't get out of bad habits, Carl.\n\n         3                  But this, as Senator Larkin said,\n\n         4       is an economic-engine driver that we often\n\n         5       overlook.  We tend to just think that, you\n\n         6       know, our aviation system in New York State is\n\n         7       just there, the airports just kind of function\n\n         8       on their own.  And we have dedicated\n\n         9       individuals like Carl and his colleagues who\n\n        10       make sure that things move forward in a very\n\n        11       positive direction.\n\n        12                  They are indeed a critical part of\n\n        13       economic development in this state and how we\n\n        14       transport, how we bring people in. The ups and downs over decades\n\n        17       are too much to enumerate in a moment on the\n\n        18       floor.\n\n        19                  But there's no question that Lower\n\n        20       Manhattan, Little Italy, the communities that\n\n        21       have recovered from the September 11, 2001,\n\n        22       attacks, that have thrived and changed over\n\n        23       centuries, have been where so many of us,\n\n        24       wherever we're from today, had our families\n\n        25       begin down at the southern tip of Manhattan,\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1543\n\n\n\n         1       are better off because of the work that Anne\n\n         2       Compoccia dedicated in many roles over many,\n\n         3       many years.\n\n         4                  Lower Manhattan, Little Italy --\n\n         5       the entire state -- are less for having lost\n\n         6       her. This year has special and very\n\n        22       sad significance.  This Friday, March 25th,\n\n        23       will be the 100th anniversary of their cruel,\n\n        24       senseless deaths.\n\n        25                  The Triangle Fire was the worst\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1552\n\n\n\n         1       industrial disaster in the history of\n\n         2       New York.  The tragedy also marks a critical\n\n         3       moment in New York labor history and served as\n\n         4       a catalyst for much-needed reforms.  And so on\n\n         5       this anniversary we honor the victims by\n\n         6       recalling not only the horror and the\n\n         7       heartbreak but the resilience and power of\n\n         8       their colleagues in fighting to improve\n\n         9       workplace conditions.\n\n        10                  The 500 employees of the Triangle\n\n        11       Shirtwaist Factory worked six days a week\n\n        12       without breaks.  The doors were locked from\n\n        13       the outside.  Talking was forbidden, bathroom\n\n        14       breaks monitored, and employees were even\n\n        15       forced to buy their own needles and thread.\n\n        16                  Despite a widespread protest that\n\n        17       occurred in 1909, where the workers staged a\n\n        18       walkout, Triangle management still refused to\n\n        19       recognize a union and never met the demands to\n\n        20       unlock the doors and to create functional fire\n\n        21       escapes.  So when the fire broke out in a\n\n        22       scrap bin one Saturday, there was no alarm and\n\n        23       there was no way out.\n\n        24                  Hundreds of workers were left with\n\n        25       no choice but to leap from ninth- and\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1553\n\n\n\n         1       tenth-floor windows.  The newspapers of that\n\n         2       day offered graphic, sickening, sad, violent\n\n         3       descriptions of the scene.  And the gruesome\n\n         4       details will forever be in the minds, hearts,\n\n         5       and memories of New Yorkers.\n\n         6                  However, a century later, we are\n\n         7       able to mark the legacy of what happened that\n\n         8       day.  And that legacy is in our child labor\n\n         9       laws, in employee safety regulations, in\n\n        10       40-hour working weeks and collective\n\n        11       bargaining rights.  Those deaths, those\n\n        12       horrible deaths, the legacy has served to\n\n        13       bring fairness and dignity to workers\n\n        14       regardless of age, national origin, gender.\n\n        15                  You know, it may be easy and sadly\n\n        16       it seems too easy now to take this history for\n\n        17       granted.  And it's maybe too easy to dismiss,\n\n        18       to just ignore the place of labor in our\n\n        19       history.  But this history of good that came\n\n        20       from a tragedy includes the legacy which we\n\n        21       provide for immigrants and really those who\n\n        22       are ignored and belittled, around the margins\n\n        23       of our society.\n\n        24                  And we're marking this anniversary\n\n        25       especially so that we never forget our own\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1554\n\n\n\n         1       heritage as New Yorkers and that we never,\n\n         2       ever forget the unthinkable struggles and\n\n         3       tragedy of our ancestors.\n\n         4                  Shortly after the fire, the factory\n\n         5       owners went on trial for manslaughter.  They\n\n         6       were acquitted.  No criminal charges, they\n\n         7       were acquitted.  They paid out $75 per victim\n\n         8       in a civil suit.  In contrast, the insurance\n\n         9       company reimbursed the owners nearly $60,000\n\n        10       more than what was reported in losses.  And\n\n        11       two years later, when one of the owners was\n\n        12       caught again locking the doors of his\n\n        13       factories from the outside, he was fined $20.\n\n        14                  But again, the Triangle Fire was a\n\n        15       galvanizing event for New York labor, and the\n\n        16       day after that tragedy 15,000 shirtwaist\n\n        17       workers demonstrated for better conditions.\n\n        18       And the record exists of the editorials and\n\n        19       the pamphlets that were written in Italian and\n\n        20       German and Yiddish and probably dozens of\n\n        21       other languages, demanding change.\n\n        22                  And this terrible thing brought\n\n        23       together Catholic reformers, socialist\n\n        24       organizers, machine politicians and teenage\n\n        25       girls who worked in factories.  And they\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1555\n\n\n\n         1       joined together to fight for workers' rights.\n\n         2                  And in response to that widespread\n\n         3       organizing, based on the outrage of what had\n\n         4       happened, this very legislature convened the\n\n         5       1911 Factory Commission which led to overhauls\n\n         6       of fire code regulations, evacuation rules,\n\n         7       sanitary requirements and over 30 total\n\n         8       workplace-safety laws.  Committee cochair\n\n         9       Robert Wagner went on to author the landmark\n\n        10       National Labor Relations Act.\n\n        11                  A woman named Rose Schneiderman of\n\n        12       the Women's Trade Union League told an\n\n        13       audience at the Metropolitan Opera House the\n\n        14       day after the tragedy:  \"I know from\n\n        15       experience it is up to the working people to\n\n        16       save themselves.  The only way they can is by\n\n        17       a strong working-class movement.\"\n\n        18                  And New York's own Frances Perkins,\n\n        19       later President Roosevelt's Commissioner of\n\n        20       Labor, called the Triangle Fire \"the day the\n\n        21       New Deal began.\"\n\n        22                  The reforms made in the years after\n\n        23       the Triangle Fire illustrate for us the\n\n        24       strength of the traditionally marginalized --\n\n        25       of women, of new immigrants, of the poor and\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1556\n\n\n\n         1       of the young.  And the progress made on\n\n         2       workers' rights in the Progressive Era and the\n\n         3       New Deal and throughout the history of\n\n         4       New York -- proud parts, parts of New York's\n\n         5       history that we must remain proud of and hold\n\n         6       sacrosanct -- shows us what we can achieve\n\n         7       when people on the edges of society unite and\n\n         8       speak.\n\n         9                  And when people march together and\n\n        10       organize together, they can demand of us in\n\n        11       government what is rightfully theirs:  A safe\n\n        12       working environment, a living wage, respect.\n\n        13       That's the legacy of the Triangle Fire.  It's\n\n        14       a legacy of collective action and social\n\n        15       change, and it was literally forged in fire\n\n        16       and blood.\n\n        17                  And because of that terrible\n\n        18       tragedy, the rest of us are able to live\n\n        19       better lives and we have a chance to have\n\n        20       future generations that will also have better\n\n        21       lives. Let me join my colleague\n\n         4       Senator Duane and others who are going to\n\n         5       support this on the 100th anniversary of the\n\n         6       Shirtwaist Fire.\n\n         7                  And clearly, as my colleague\n\n         8       Senator Duane pointed out, horrific events\n\n         9       occurred to large numbers of people when\n\n        10       policies weren't in place and people weren't\n\n        11       working toward protecting those that may be\n\n        12       helping them share in profits.\n\n        13                  And in this case, the loss of any\n\n        14       life is critically important. And I join him\n\n         4       and Senator Robach and I'm sure everyone else\n\n         5       in this room in what is appropriate for the\n\n         6       New York State Senate to stop in its\n\n         7       deliberations and recognize the importance of\n\n         8       the Triangle Shirtwaist Factory Fire, not just\n\n         9       for the tragedy that occurred 100 years ago,\n\n        10       but for the advances in workers' rights that\n\n        11       followed that tragedy.\n\n        12                  Every advance in workers' rights\n\n        13       began as a result of a tragedy.  And I think\n\n        14       it's particularly important that now, at this\n\n        15       time, this 100th anniversary could not be\n\n        16       coming at a more important time for working\n\n        17       people in this country.\n\n        18                  It would be very easy to turn the\n\n        19       clock back on the rights of workers.  As we\n\n        20       speak, across the country in state houses and\n\n        21       governors are looking to curtail the\n\n        22       collective bargaining rights of public\n\n        23       employees right now.  Sadly, many\n\n        24       private-sector employees no longer have a\n\n        25       voice in organized labor.\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1560\n\n\n\n         1                  So I think it's very important that\n\n         2       we not only pause, recognize what happened on\n\n         3       that day, reflect on how it should never\n\n         4       happen again, but we should be ever mindful\n\n         5       and vigilant that if the representatives of\n\n         6       working people are stripped of their right to\n\n         7       represent them, if they no longer have a\n\n         8       viable labor movement in this country, if we\n\n         9       say that unions don't have the ability to have\n\n        10       automatic dues deductions so they can have an\n\n        11       organized effort to counteract some of these\n\n        12       antilabor governors and legislators across the\n\n        13       country, we could have another Triangle\n\n        14       Shirtwaist Factory Fire.\n\n        15                  Without a strong labor movement,\n\n        16       you will see OSHA laws disappear just like\n\n        17       that.  Without a strong labor movement, we\n\n        18       will see minimum wage laws disappear just like\n\n        19       that.  We will see working people forced in\n\n        20       never-ending race to the bottom.  That was the\n\n        21       legacy of the Triangle Shirtwaist Factory\n\n        22       Fire -- not only that we stop and recognize\n\n        23       the tragedy on that day and the positive\n\n        24       changes that came about for working people,\n\n        25       but we do not allow their deaths to be in\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1561\n\n\n\n         1       vain, we do not turn back the clock in an\n\n         2       effort to somehow deal with a budget crisis\n\n         3       that is not the fault of working people who\n\n         4       are struggling every day.  Never before in\n\n         5       history have we needed a strong organized\n\n         6       labor movement more than we need it today.\n\n         7       That is the legacy of the Triangle Shirtwaist\n\n         8       Factory Fire.\n\n         9                  So I want to thank Senator Duane\n\n        10       for bringing this resolution, Senator Robach\n\n        11       for his comments. And it is certainly well deserved.\n\n        25                  Carlos Valdez grew up on the Lower\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1564\n\n\n\n         1       East Side of Manhattan in a public housing\n\n         2       development, first born in Alfred E. Smith\n\n         3       Houses and has lived for the last 13 years in\n\n         4       Baruch Houses, both in the heart of the Lower\n\n         5       East Side.\n\n         6                  He has been committed, he told me\n\n         7       this morning, to working for NASA his whole\n\n         8       life.  Many of us I think as children loved\n\n         9       that idea; the difference with Carlos is he\n\n        10       continues to and has the talents and the skill\n\n        11       to get there.\n\n        12                  He is currently a senior in high\n\n        13       school at Bard High School Early College.  And\n\n        14       he won't just be graduating from high school\n\n        15       this June, he'll be graduating from high\n\n        16       school and concurrently getting an associate's\n\n        17       degree, heading off to college next year and\n\n        18       from there hopefully on to graduate school to\n\n        19       become an engineer and, I am certain, to meet\n\n        20       his dream of going to work for NASA and\n\n        21       becoming an astronaut.\n\n        22                  You know, Carlos Valdez comes here\n\n        23       today along with the 34 others who are being\n\n        24       honored by the Boys & Girls Clubs of America,\n\n        25       each one of whom stands out in their local\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1565\n\n\n\n         1       clubhouse.  His is the Education Alliance\n\n         2       Clubhouse, known as the Edgies Clubhouse,\n\n         3       which every year sends a student.  And each of\n\n         4       the 35 students were incredibly deserving.\n\n         5                  Carlos wrote a speech about the\n\n         6       power of youth and the power of youth to\n\n         7       really make a difference.  And his background,\n\n         8       his commitment and his speech have really made\n\n         9       him stand out.  He will now be heading on to\n\n        10       the Northeast Regionals, from there I'm sure\n\n        11       to the nationals, and from there to an\n\n        12       extraordinary future.\n\n        13                  I would say as well that the\n\n        14       Educational Alliance Clubhouse now has two of\n\n        15       the last three statewide Youths of the Year.\n\n        16       And Amarilis Perez from Educational Alliance,\n\n        17       who runs the clubhouse, is due enormous credit\n\n        18       as well and is also here in the chamber with\n\n        19       us.\n\n        20                  You know, it is hard for so many\n\n        21       young people in New York to grow up.  Senator\n\n        22       Duane just spoke movingly about the history a\n\n        23       hundred years ago, and others.  The challenge\n\n        24       continues to exist for so many.  And for so\n\n        25       many young people, because of the challenges\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1566\n\n\n\n         1       they face, it's just too easy to give up.  But\n\n         2       that's not true for Carlos, it's not true for\n\n         3       the other Youths of the Year who are up here,\n\n         4       it's not true for the other ones competing\n\n         5       nationally.\n\n         6                  And I think we as a Senate, as a\n\n         7       body, should really take that lesson to heart\n\n         8       and that message to heart. In a\n\n        18       staged accident the participants risk their\n\n        19       own safety, their target's safety, as well as\n\n        20       the safety of the general motoring public.\n\n        21                  And the bill before us is referred\n\n        22       to as Alice's Law.  It's named after Alice\n\n        23       Ross, who was a 70-year-old grandmother who\n\n        24       was killed as a result of a staged accident in\n\n        25       the New York City borough of Queens.  In fact,\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1570\n\n\n\n         1       today is the eighth anniversary of the death\n\n         2       of Alice Ross.\n\n         3                  Mrs. Ross was on her way to her\n\n         4       daughter's house when she was intentionally\n\n         5       struck in the rear of her vehicle by three men\n\n         6       who were out searching for an unsuspecting\n\n         7       victim.  And the impact of this staged\n\n         8       accident caused Mrs. Ross's vehicle to leave\n\n         9       the highway and crash head-on into a tree,\n\n        10       causing her death.\n\n        11                  And after the accident the three\n\n        12       perpetrators, as is the case in these staged\n\n        13       accidents, they were taken to a medical center\n\n        14       where they feigned an assortment of injuries\n\n        15       in order to collect on phony injury claims\n\n        16       through the no-fault system.\n\n        17                  So this bill will not only help to\n\n        18       contain no-fault fraud and reduce insurance\n\n        19       premiums, but it also will create safety for\n\n        20       everyone on our roadways.  It is critical that\n\n        21       we take steps to crack down on the criminals\n\n        22       who perpetrate no-fault fraud and harm\n\n        23       innocent people like Alice Ross in the\n\n        24       process.\n\n        25                  Because no-fault fraud is on the\n\n\n\n                      Candyco Transcription Service, Inc.\n\f                                                        1571\n\n\n\n         1       rise across the state, particularly in the\n\n         2       New York City area.
