There are a lot of conversations going \n\n17  on.  Staff members should leave the chamber.  \n\n18  Members should take their seats.  \n\n19               I believe that Senator Breslin has \n\n20  the floor, and it's difficult for me, who is \n\n21  right next to Senator Breslin, to even hear him \n\n22  with all of the chatter that goes on in the \n\n23  chamber.  The chamber is a place where members \n\n24  are allowed to speak if called on by the chair.  \n\n25  Nobody else should be speaking at that time.  \n\n\f                                                               2680\n\n 1               Thank you, Mr. President.\n\n 2               ACTING PRESIDENT GRIFFO:   Thank \n\n 3  you, Senator Libous.  \n\n 4               Thank you, Senator Breslin.  \n\n 5               I appreciate the order in the \n\n 6  chamber.\n\n 7               Senator Breslin, upon review of \n\n 8  your point, we deem that the resolutions are not \n\n 9  considered privileged because they must receive \n\n10  the consent of the Temporary President in order \n\n11  to be brought before the house as a privileged \n\n12  resolution. All those --\n\n18               SENATOR BRESLIN:   I request to be \n\n19  heard on the appeal.\n\n20               ACTING PRESIDENT GRIFFO:   You \n\n21  may be heard, Senator Breslin.  \n\n22               SENATOR BRESLIN:   Mr. President, \n\n23  the resolutions I'm offering today establish \n\n24  plans setting forth an itemized list of grantees \n\n25  for certain school districts across the state.  \n\n\f                                                               2681\n\n 1               The proposed allocations of school \n\n 2  district money, commonly referred to as bullet \n\n 3  aid, conform fully to the provisions of \n\n 4  Senate Rule 9, Section 11, relating to conference \n\n 5  allocations for community projects and local \n\n 6  assistance.  \n\n 7               The first resolution would allocate \n\n 8  the remaining $5 million for bullet aid for the \n\n 9  years 2011 and 2012 that was mysteriously absent \n\n10  from the resolution this house passed just last \n\n11  week.\n\n12               The second would allocate the full \n\n13  $20 million for fiscal year 2012-2013 in an \n\n14  equitable manner to all Senators' districts, \n\n15  regardless of party, pursuant to State Senate \n\n16  rules and the formula for school aid \n\n17  distribution.\n\n18               Pursuant to the Deputy Majority \n\n19  Leader's declaration and the urgency of the \n\n20  proposed and much-needed aid to school districts \n\n21  throughout the state, I insist that the \n\n22  resolution be read and considered for adoption.  \n\n23               Thank you, Mr. President.\n\n24               ACTING PRESIDENT GRIFFO:   Thank \n\n25  you, Senator Breslin.  \n\n\f                                                               2682\n\n 1               The question is on overruling the \n\n 2  ruling of the chair. This \n\n 3  act shall take effect on the first of November.\n\n 4               ACTING PRESIDENT GRIFFO:   Call the \n\n 5  roll.\n\n 6               (The Secretary called the roll.)\n\n 7               ACTING PRESIDENT GRIFFO:   Senator \n\n 8  Rivera to explain his vote.\n\n 9               SENATOR RIVERA:   Thank you, \n\n10  Mr. President, to explain my vote.\n\n11               This is a bill much like ones that \n\n12  we've voted on in weeks past and sessions past \n\n13  that deals with sex offenders but yet does not \n\n14  make the distinction by levels.  \n\n15               There is another bill on the agenda \n\n16  today that does something different; however, it \n\n17  has the same problem.\n\n18               As I've stated many times on the \n\n19  floor, I certainly believe that it is our \n\n20  responsibility to secure citizens from \n\n21  predators.  But when we establish rules -- bills \n\n22  like this, when we try to establish laws of this \n\n23  kind which are so broad and do not have the \n\n24  distinctions that are already established in law, \n\n25  when someone is a sex offender and has served \n\n\f                                                               2684\n\n 1  their time, then we create a law that is too \n\n 2  broad and that certainly I believe has more of a \n\n 3  punitive effect.  \n\n 4               Which, again, as I've stated, can \n\n 5  certainly be warranted for certain people that \n\n 6  are considered sex offenders, but certainly not \n\n 7  Level 1's.  \n\n 8               Since this does not have that \n\n 9  distinction, I'll be voting in the negative.\n\n10               Thank you, Mr. President.\n\n11               ACTING PRESIDENT GRIFFO:   Senator \n\n12  Rivera to be recorded in the negative.  \n\n13               Announce the results.\n\n14               THE SECRETARY:   In relation to \n\n15  Calendar Number 322, those recorded in the \n\n16  negative are Senators Hassell-Thompson, Krueger, \n\n17  Montgomery, Parker, Perkins and Rivera.\n\n18               Ayes, 54. To me, this is probably -- this is \n\n 5  extremely egregious because it does not make the \n\n 6  distinction between someone that is a predator \n\n 7  and someone who is not.  \n\n 8               It would make a person a sex \n\n 9  offender, regardless of the level, actually \n\n10  regardless of the offense.  There would be no \n\n11  levels anymore.  So this person, anybody who was \n\n12  convicted of a sex offense, would have to \n\n13  register for the rest of their lives.\n\n14               Now, while I think that certainly \n\n15  predators that are Level 3's currently need to \n\n16  have this -- we need to make sure that we know \n\n17  where they are, we certainly should restrict \n\n18  where they work or where they can go -- when \n\n19  we're talking about a Level 1 sex offender, that \n\n20  distinction -- there is a reason why that \n\n21  distinction exists.  \n\n22               This law would again make it too \n\n23  broad a definition.  I believe that we should be \n\n24  very careful about how we establish these levels \n\n25  on all the bills that deal with sex offenses.
