       AN ACT to amend the environmental conservation law, in relation  to  the
         prohibition of the on-site disposal of drill cuttings
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The opening paragraph of subdivision 8 of  section  23-0305
    2  of  the environmental conservation law, as amended by chapter 846 of the
    3  laws of 1981, is amended to read as follows:
    4    With respect to oil pools or fields and natural gas pools  or  fields,
    5  the department shall [have power to]:
    6    S  2.  Paragraph k of subdivision 8 of section 23-0305 of the environ-
    7  mental conservation law is relettered paragraph 1 and a new paragraph  k
    8  is added to read as follows:
    9    K.  PROHIBIT  THE  ON-SITE STORAGE, FOR MORE THAN 45 DAYS, DISPOSAL OR
   10  BURIAL OF DRILL CUTTINGS AND DRILL  CUTTING  SAMPLES  FROM  NATURAL  GAS
   11  WELLS.    THE  DRILL  CUTTINGS  SHALL  ONLY  BE STORED ON AN IMPERMEABLE
   12  SURFACE.
   13    S 3. This act shall take effect on the ninetieth day  after  it  shall
   14  have become a law.
