       AN  ACT  to  amend  chapter  420  of  the  laws of 1998, relating to the
         creation of the Piermont library district, in relation to the  polling
         place and hours of voting for library elections
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraph (c) of subdivision 1 and subdivision 2 of section
    2  2 of chapter 420 of the laws of 1998, relating to the  creation  of  the
    3  Piermont library district, is amended to read as follows:
    4    (c)  the  election of nine trustees as hereinafter provided. The trus-
    5  tees of the existing Piermont public library shall give notice  of  said
    6  election by the publication of a notice in one or more newspapers having
    7  a  general  circulation in the district to be served. The first publica-
    8  tion of such notice shall be not less than thirteen days  and  not  more
    9  than  twenty  days  prior to the date of such election. In addition, the
   10  board of trustees of the existing Piermont public  library  shall  cause
   11  copies  of such notice to be posted conspicuously in three public places
   12  in the village at  least  thirteen  days  prior  to  the  date  of  such
   13  election.  Such  notice  shall specify the time when and the place where
   14  such election will be held, the issues to be decided  at  said  election
   15  and  the  hours  during  which  polls  will  be  open for the receipt of
   16  ballots. The board of trustees of the existing Piermont  public  library
   17  shall  prepare  the ballots for such election and the polls shall remain
   18  open for the receipt thereof [at all elections]  from  6:00  a.m.  until
   19  9:00  p.m.  The  board  of trustees shall designate a resident qualified
   20  voter of such district to act as chairperson of  any  election  of  such
   21  district  and shall designate not less than two nor more than four resi-
   22  dent qualified voters at the polling place [which shall be  the  village

A. 7652--A 2 1 hall] to act as election inspectors and ballot clerks at such elections. 2 No trustee shall serve as chairperson or as an election inspector or 3 ballot clerk. The board of trustees may adopt a resolution providing 4 that such chairperson, election inspectors and ballot clerks shall be 5 paid for their respective services at the initial election. Such resol- 6 ution, if adopted, may fix reasonable compensation for the services of 7 such official. Every voter of the village, otherwise qualified to vote 8 at a village election shall be qualified to vote at said election. After 9 the polls have closed at said election, the election inspectors and the 10 ballot clerks shall immediately canvass publicly the ballots cast and 11 the chairperson of the election shall publicly announce the result. 12 Within seventy-two hours thereafter, the chairperson, election inspec- 13 tors and ballot clerks shall execute and file a certificate of the 14 result of the canvass with the board of trustees and with the clerks of 15 the village of Piermont. 16 2. In the event that the district is created there shall be an annual 17 election conducted by the board of trustees of the Piermont library 18 district in accordance with the provisions of subdivision one of this 19 section, at a time to be set by the board, at which election vacancies 20 on the board of trustees shall be filled and at which any proposed budg- 21 et which the board shall determine to submit to the voters pursuant to 22 section four of this act shall be submitted to the voters. THE POLLING 23 PLACE FOR ANNUAL ELECTIONS SHALL BE THE DENNIS P. MCHUGH PIERMONT 24 PUBLIC LIBRARY AND THE POLLS SHALL REMAIN OPEN FROM 11:00 A.M. UNTIL 25 8LABOR P.M. 26 S 2. This act shall take effect immediately.
