         tion  --  recommitted to the Committee on Education in accordance with
         Senate Rule 6, sec. 8 -- committee discharged, bill  amended,  ordered
         reprinted as amended and recommitted to said committee
       AN  ACT  to  amend  the education law, in relation to requiring tax levy
         information and percentage increase to be sent to all voters
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Paragraph  a  of  subdivision  2-a of section 2022 of the
    2  education law, as amended by section 7 of part A of chapter  97  of  the
    3  laws of 2011, is amended to read as follows:
    4    a.  Commencing  with the proposed budget for the two thousand one--two
    5  thousand two school year, such notice shall also include  a  description
    6  of  how  total  spending  and  the  tax  levy,  AND, COMMENCING WITH THE
    7  PROPOSED BUDGET FOR  THE  TWO  THOUSAND  TWELVE--TWO  THOUSAND  THIRTEEN
    8  SCHOOL YEAR, THE PERCENTAGE INCREASE OR DECREASE IN THE TAX LEVY result-
    9  ing  from the proposed budget would compare with a projected contingency
   10  budget adopted pursuant to section two  thousand  twenty-three  of  this
   11  [article]  PART, assuming that such contingency budget is adopted on the
   12  same day as the vote on the proposed budget. Such comparison shall be in
   13  total and by component (program, capital and administrative), and  shall
   14  include  a statement of the assumptions made in estimating the projected
   15  contingency budget.
   16    S 2. Paragraph a of subdivision 2-a of section 2022 of  the  education
   17  law,  as added by section 3 of part A of chapter 60 of the laws of 2000,
   18  is amended to read as follows:
   19    a. Commencing with the proposed budget for the two  thousand  one--two
   20  thousand  two  school year, such notice shall also include a description
   21  of how total spending  and  the  tax  levy,  AND,  COMMENCING  WITH  THE
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                             [ ] is old law to be omitted.

S. 466--A 2 1 PROPOSED BUDGET FOR THE TWO THOUSAND ELEVEN--TWO THOUSAND TWELVE SCHOOL 2 YEAR, THE PERCENTAGE INCREASE OR DECREASE IN THE TAX LEVY resulting from 3 the proposed budget would compare with a projected contingency budget 4 adopted pursuant to section two thousand twenty-three of this [article] 5 PART, assuming that such contingency budget is adopted on the same day 6 as the vote on the proposed budget. Section 1716 of the education law is amended by adding two new 11 subdivisions 8 and 9 to read as follows: 12 8. COMMENCING WITH THE PROPOSED BUDGET FOR THE TWO THOUSAND 13 TWELVE--TWO THOUSAND THIRTEEN SCHOOL YEAR, THE PROPERTY TAX REPORT CARD 14 SHALL BE MAILED TO ALL QUALIFIED VOTERS OF THE SCHOOL DISTRICT AFTER THE 15 DATE OF THE BUDGET HEARING, BUT NO LATER THAN SIX DAYS PRIOR TO THE 16 ANNUAL MEETING AND ELECTION OR SPECIAL DISTRICT MEETING AT WHICH A 17 SCHOOL BUDGET VOTE WILL OCCUR. 18 9. COMMENCING WITH THE PROPOSED BUDGET FOR THE TWO THOUSAND 19 TWELVE--TWO THOUSAND THIRTEEN SCHOOL YEAR, ALL DOCUMENTS PREPARED BY THE 20 BOARD OF EDUCATION AND/OR SCHOOL DISTRICT THAT INFORM THE PUBLIC, WHETH- 21 ER BY ELECTRONIC, HARDCOPY, OR OTHER MEANS, ABOUT PROPOSED TAX RATE 22 INCREASES OR DECREASES, AND/OR PERCENTAGE INCREASES OR DECREASES, 23 RESULTING FROM A PROPOSED BUDGET, SHALL INCLUDE THE PROPOSED BUDGET 24 INCREASE OR DECREASE, AND PERCENTAGE INCREASE OR DECREASE, AND THE 25 PROPOSED TAX LEVY INCREASE OR DECREASE, AND PERCENTAGE INCREASE OR 26 DECREASE, ON THE SAME PAGE, AND IN THE SAME FONT STYLE AND SIZE, AS THE 27 PROPOSED TAX RATE CHANGE. 28 S 4. Section 1608 of the education law is amended by adding two new 29 subdivisions 8 and 9 to read as follows: 30 8. COMMENCING WITH THE PROPOSED BUDGET FOR THE TWO THOUSAND 31 TWELVE--TWO THOUSAND THIRTEEN SCHOOL YEAR, THE PROPERTY TAX REPORT CARD 32 SHALL BE MAILED TO ALL QUALIFIED VOTERS OF THE SCHOOL DISTRICT AFTER THE 33 DATE OF THE BUDGET HEARING, BUT NO LATER THAN SIX DAYS PRIOR TO THE 34 ANNUAL MEETING AND ELECTION OR SPECIAL DISTRICT MEETING AT WHICH A 35 SCHOOL BUDGET VOTE WILL OCCUR. 36 9. COMMENCING WITH THE PROPOSED BUDGET FOR THE TWO THOUSAND 37 TWELVE--TWO THOUSAND THIRTEEN SCHOOL YEAR, ALL DOCUMENTS PREPARED BY THE 38 BOARD OF EDUCATION AND/OR SCHOOL DISTRICT THAT INFORM THE PUBLIC, WHETH- 39 ER BY ELECTRONIC, HARDCOPY, OR OTHER MEANS, ABOUT PROPOSED TAX RATE 40 INCREASES OR DECREASES, AND/OR PERCENTAGE INCREASES OR DECREASES, 41 RESULTING FROM A PROPOSED BUDGET, SHALL INCLUDE THE PROPOSED BUDGET 42 INCREASE OR DECREASE, AND PERCENTAGE INCREASE OR DECREASE, AND THE 43 PROPOSED TAX LEVY INCREASE OR DECREASE, AND PERCENTAGE INCREASE OR 44 DECREASE, ON THE SAME PAGE, AND IN THE SAME FONT STYLE AND SIZE, AS THE 45 PROPOSED TAX RATE CHANGE. 46 S 5. This act shall take effect on the first of July next succeeding 47 the date on which it shall have become a law; provided, however, that 48 the amendments to paragraph a of subdivision 2-a of section 2022 of the 49 education law, made by section one of this act, shall be subject to the 50 expiration and reversion of such section pursuant to section 13 of part 51 A of chapter 97 of the laws of 2011, as amended, when upon such date the 52 provisions of section two of this act shall take effect; provided 53 further that effective immediately, the addition, amendment and/or 54 repeal of any rule or regulation necessary for the implementation of 55 this act on its effective date are authorized and directed to be made 56 and completed on or before such effective date.
