       AN ACT to repeal certain provisions of the public authorities law relat-
         ing  to  certain  authorities  and  to transfer any books, records and
         remaining  rights  of  any  dissolved  authority  to  an  identifiable
         location
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1.   Legislative intent.   It  is  hereby  declared  to  be  a
    2  substantial interest of this state that residents, governments and busi-
    3  nesses have certainty in the corporate status and orderly dissolution of
    4  public  authorities  and parking authorities, and that upon dissolution,
    5  their enabling statutes will be repealed and their  books,  records  and
    6  remaining  rights,  if  any,  will  be  transferred  to  an identifiable
    7  location. The welfare  of  the  state  necessitates  ensuring  that  the
    8  proliferation  of  moribund  public  benefit corporations, such as those
    9  included in this act found to be defunct by the comptroller, the author-
   10  ities budget office and the New York state commission on public authori-
   11  ty reform, does not continue unchecked.
   12    S 2.  Title 5 of article 4 of the public authorities law is REPEALED.
   13    S 2-a. Notwithstanding any other provision of law to the contrary, any
   14  existing records, property, rights, titles, and  interest  of  the  Long
   15  Island market authority shall vest in and be possessed by Suffolk county
   16  and its successors or assigns.

S. 5198--B 2 1 S 3. Title 6-D of article 5 of the public authorities law is REPEALED. 2 S 3-a. Notwithstanding any other provision of law to the contrary, any 3 existing facilities, rights and property of the Alfred, Almond, 4 Hornellsville sewer authority shall be disposed of as shall be agreed 5 upon by all of the members of the authority. 6 S 4. Title 1 of article 7 of the public authorities law is REPEALED. 7 S 4-a. Notwithstanding any other provision of law to the contrary, any 8 existing records, property, rights, titles and interest and all obli- 9 gations and liabilities of the Amsterdam parking authority shall vest in 10 and be possessed by the city of Amsterdam and its successors or assigns. 11 S 5. Title 1-A of article 7 of the public authorities law is REPEALED. 12 S 5-a. Notwithstanding any other provision of law to the contrary, any 13 existing real property shall pass to the village in which it is located, 14 and if outside the limits of any village, to the town in which located. 15 All other property of the Monroe regional parking authority shall be 16 equally divided among the town of Monroe and the villages of Monroe and 17 Harriman and their successors or assigns. 18 S 6. Title 1-B of article 7 of the public authorities law is 19 REPEALED. 20 S 6-a. Notwithstanding any other provision of law to the contrary, any 21 existing records, property, rights, titles, and interest of the Johnson 22 City parking authority shall vest in and be possessed by Johnson City 23 and its successors or assigns. 24 S 7. Title 2-A of article 7 of the public authorities law is REPEALED. 25 S 7-a. Notwithstanding any other provision of law to the contrary, any 26 existing records, property, rights, titles and interest and all obli- 27 gations and liabilities of the Hudson parking authority shall vest in 28 and be possessed by the city of Hudson and its successors or assigns. 29 S 8. Title 3 of article 7 of the public authorities law is REPEALED. 30 S 8-a. Notwithstanding any other provision of law to the contrary, any 31 existing records, property, rights, titles and interest and all obli- 32 gations and liabilities of the Elmira parking authority shall vest in 33 and be possessed by the city of Elmira and its successors or assigns. 34 S 9. Title 5 of article 7 of the public authorities law is REPEALED. 35 S 9-a. Notwithstanding any other provision of law to the contrary, any 36 existing records, property, rights, titles and interest and all obli- 37 gations and liabilities of the Peekskill parking authority shall vest in 38 and be possessed by the city of Peekskill and its successors or assigns. 39 S 10. Title 6 of article 7 of the public authorities law is REPEALED. 40 S 10-a. Notwithstanding any other provision of law to the contrary, 41 any existing records, property, rights, titles and interest and all 42 obligations and liabilities of the Fulton parking authority shall vest 43 in and be possessed by the city of Fulton and its successors or assigns. 44 S 11. Title 8 of article 7 of the public authorities law is REPEALED. 45 S 11-a. Notwithstanding any other provision of law to the contrary, 46 any existing records, property, rights, titles, and interest of the city 47 of Troy parking authority shall vest in and be possessed by the city of 48 Troy and it successors or assigns. 49 S 12. Title 9 of article 7 of the public authorities law is REPEALED. 50 S 12-a. Notwithstanding any other provision of law to the contrary, 51 any existing records, property, rights, titles and interest and all 52 obligations and liabilities of the Port Jervis parking authority shall 53 vest in and be possessed by the city of Port Jervis and its successors 54 or assigns. 55 S 13. Title 9-A of article 7 of the public authorities law is 56 REPEALED.

Notwithstanding any other provision of law to the contrary, 2 any existing records, property, rights, titles and interest and all 3 obligations and liabilities of the Utica parking authority shall vest in 4 and be possessed by the city of Utica and its successors or assigns. 5 S 14. Title 10 of article 7 of the public authorities law is REPEALED. 6 S 14-a. Notwithstanding any other provision of law to the contrary, 7 any existing records, property, rights, titles and interest and all 8 obligations and liabilities of the Owego parking authority shall vest in 9 and be possessed by the village of Owego and its successors or assigns. 10 S 15. Title 12 of article 7 of the public authorities law is REPEALED. 11 S 15-a. Notwithstanding any other provision of law to the contrary, 12 any existing records, property, rights, titles and interest and all 13 obligations and liabilities of the city of New Rochelle parking authori- 14 ty shall vest in and be possessed by the city of New Rochelle and its 15 successors or assigns. 16 S 16. Title 13 of article 7 of the public authorities law is REPEALED. 17 S 16-a. Notwithstanding any other provision of law to the contrary, 18 any existing records, property, rights, titles and interest and all 19 obligations and liabilities of the city of Poughkeepsie parking authori- 20 ty shall vest in and be possessed by the city of Poughkeepsie and its 21 successors or assigns. 22 S 17. Title 15 of article 7 of the public authorities law is REPEALED. 23 S 17-a. Notwithstanding any other provision of law to the contrary, 24 any existing records, property, rights, titles and interest and all 25 obligations and liabilities of the village of Spring Valley parking 26 authority shall vest in and be possessed by the village of Spring Valley 27 and its successors or assigns. 28 S 18. Title 17 of article 7 of the public authorities law is REPEALED. 29 S 18-a. Notwithstanding any other provision of law to the contrary, 30 any existing records, property, rights, titles and interest and all 31 obligations and liabilities of the city of Long Beach parking authority 32 shall vest in and be possessed by the city of Long Beach and its succes- 33 sors or assigns. 34 S 19. Title 19 of article 7 of the public authorities law is REPEALED. 35 S 19-a. Notwithstanding any other provision of law to the contrary, 36 any existing records, property, rights, titles and interest and all 37 obligations and liabilities of the city of North Tonawanda parking 38 authority shall vest in and be possessed by the city of North Tonawanda 39 and its successors or assigns. 40 S 20. Title 7 of article 8 of the public authorities law is REPEALED. 41 S 20-a. Notwithstanding any other provision of law to the contrary, 42 any existing records, property, rights, titles and interest and all 43 obligations and liabilities of the Salamanca hospital district authority 44 shall vest in and be possessed by the city of Salamanca and its succes- 45 sors or assigns. 46 S 21. Title 7-A of article 8 of the public authorities law is 47 REPEALED. 48 S 21-a. Notwithstanding any other provision of law to the contrary, 49 any existing records, property, rights, titles and interest and all 50 obligations and liabilities of the Salamanca Indian lease authority 51 shall vest in and be possessed by the city of Salamanca and their 52 successors or assigns. 53 S 22. Title 8-A of article 8 of the public authorities law is 54 REPEALED. 55 S 22-a. Notwithstanding any other provision of law to the contrary, 56 any existing rights, property, assets and funds of the Long Island job
S. 5198--B 4 1 development authority shall pass to and be vested jointly in the coun- 2 ties of Nassau and Suffolk and their successors or assigns. 3 S 23. Title 10 of article 8 of the public authorities law is REPEALED. 4 S 23-a. Notwithstanding any other provision of law to the contrary, 5 any existing records, property, rights, titles and interest and all 6 obligations and liabilities of the historic Rome development authority 7 shall vest in and be possessed by the city of Rome and its successors or 8 assigns. 9 S 24. Title 10-A of article 8 of the public authorities law is 10 REPEALED. 11 S 24-a. Notwithstanding any other provision of law to the contrary, 12 any existing records, property, rights, titles and interest and all 13 obligations and liabilities of the Center Authority of Glens Falls shall 14 vest in and be possessed by the city of Glens Falls and its successors 15 or assigns. 16 S 25. Title 13-A of article 8 of the public authorities law is 17 REPEALED. 18 S 25-a. Notwithstanding any other provision of law to the contrary, 19 any existing records, property, rights, titles and interest and all 20 obligations and liabilities of the multi-town solid waste management 21 authority shall vest in and be possessed jointly by the town of Babylon 22 and the town of Huntington and their successors or assigns. 23 S 26. Title 13-D of article 8 of the public authorities law, as added 24 by chapter 930 of the laws of 1983, is REPEALED. 25 S 26-a. Notwithstanding any other provision of law to the contrary, 26 any existing records, property, rights, titles and interest and all 27 obligations and liabilities of the Broome county resource recovery agen- 28 cy shall vest in and be possessed by Broome county and its successors or 29 assigns. 30 S 27. Title 13-J of article 8 of the public authorities law is 31 REPEALED. 32 S 27-a. Notwithstanding any other provision of law to the contrary, 33 any existing records, property, rights, titles and interest and all 34 obligations and liabilities of the town of Brookhaven resource recovery 35 agency shall vest in and be possessed by the town of Brookhaven and its 36 successors or assigns. 37 S 28. Title 13-K of article 8 of the public authorities law is 38 REPEALED. 39 S 28-a. Notwithstanding any other provision of law to the contrary, 40 any existing records, property, rights, titles and interest and all 41 obligations and liabilities of the county of Essex solid waste manage- 42 ment authority shall vest in and be possessed by Essex county and its 43 successors or assigns. 44 S 29. Title 13-L of article 8 of the public authorities law, as added 45 by chapter 391 of the laws of 1992, is REPEALED. 46 S 29-a. Notwithstanding any other provision of law to the contrary, 47 any existing records, property, rights, titles and interest and all 48 obligations and liabilities of the greater Troy area solid waste manage- 49 ment authority shall vest in and be possessed by the city of Troy and 50 its successors or assigns. 51 S 30. Title 14-A of article 8 of the public authorities law is 52 REPEALED. 53 S 30-a. Notwithstanding any other provision of law to the contrary, 54 any existing records, property, rights, titles and interest and all 55 obligations and liabilities of the city of Peekskill civic center
S. 5198--B 5 1 authority shall vest in and be possessed by the city of Peekskill and 2 its successors or assigns. 3 S 31. Title 28-C of article 8 of the public authorities law is 4 REPEALED. 5 S 31-a. Notwithstanding any other provision of law to the contrary, 6 any existing records, property, rights, titles and interest and all 7 obligations and liabilities of the county of Chautauqua sports, recre- 8 ation and cultural authority shall vest in and be possessed by Chautau- 9 qua county and its successors or assigns. 10 S 32. Separability clause. If any clause, sentence, paragraph, section 11 or part of this act shall be adjudged by any court of competent juris- 12 diction to be invalid such judgment shall not affect, impair or invali- 13 date the remainder of this act, but shall be confined in its operation 14 to the clause, sentence, paragraph, section or part thereof directly 15 involved in the controversy in which such judgment shall have been 16 rendered. 17 S 33. This act shall take effect on the sixtieth day after it shall 18 have become a law.
