AN ACT to authorize the St. Paul fire district to offer an optional
twenty year retirement plan to firefighters Robert J. Anderson, Edmond
Kaspar, Timothy J. Kohlmeier, Kevin Magin, Jeremy Schaeffer, John
Semmler and Timothy Warth
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
1 Section 1. Notwithstanding any other provision of law to the contrary,
2 the St. Paul fire district, a participating employer in the New York
3 state police and fire retirement system, which previously elected to
4 offer additional pension benefits for members of the optional twenty
5 year retirement plan, established pursuant to subdivision f of section
6 384 of the retirement and social security law, to firefighters employed
7 by such district, is hereby authorized to make participation in such
8 plan available to Robert J. Anderson, Edmond Kaspar, Timothy J. Kohlmei-
9 er, Kevin Magin, Jeremy Schaeffer, John Semmler and Timothy Warth, fire-
10 fighters employed by the St. Paul fire district in the city of Roches-
11 ter, who, for reasons not ascribable to their own negligence, failed to
12 make a timely application to participate in such optional twenty year
13 retirement plan. The St. Paul fire district may so elect by filing with
14 the state comptroller, on or before December 31, 2012, a resolution of
15 its local legislative body together with certification that such fire-
16 fighters did not bar themselves from participation in such retirement
17 plan as a result of their own negligence. Thereafter, such firefighters
18 may elect to be covered by the provisions of subdivision f of section
19 384 of the retirement and social security law, and shall be entitled to
20 the full rights and benefits associated with coverage under such
21 section, by filing a request to that effect with the state comptroller
22 on or before June 30, 2013.
23 S 2. All employer past service costs associated with implementing the
24 provisions of this act shall be borne by the St. Paul fire district and
25 the past service costs associated with this act may be paid in ten equal
26 annual installments.
27 S 3. This act shall take effect immediately.
