CAHILL, COOK, CUSICK, DelMONTE, DESTITO, MAGEE, MAGNARELLI, McENENY, PAULIN, RAMOS, REILLY, WEINSTEIN read once and referred to the Committee on Real Property Taxation AN ACT to amend the real property tax law, in relation to the issuance of a receipt for the filing of a STAR application THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraph (a) of subdivision 6 of section 42 of the real 2 property tax law, as added by section 1 of part B of chapter 389 of the 3 laws of 1997, is amended to read as follows: 4 (a) Generally. All owners of the property who primarily reside thereon must jointly file an application for exemption with the assessor on or 6 before the appropriate taxable status date. Such application may be 7 filed by mail if it is enclosed in a postpaid envelope properly 8 addressed to the appropriate assessor, deposited in a post office or 9 official depository under the exclusive care of the United States postal 1 service, and postmarked by the United States postal service on or before 11 the applicable taxable status date. Each such application shall be made 12 on a form prescribed by the state board, which shall require the appli 13 cant or applicants to agree to notify the assessor if their primary 14 residence changes while their property is receiving the exemption. The 1 assessor may request that proof of residency be submitted with the 16 application. IF THE APPLICANT REQUESTS A RECEIPT FROM THE ASSESSOR AS 17 PROOF OF SUBMISSION OF THE APPLICATION, THE ASSESSOR SHALL PROVIDE SUCH 18 RECEIPT. IF SUCH REQUEST IS MADE BY OTHER THAN PERSONAL REQUEST, THE 19 APPLICANT SHALL PROVIDE THE ASSESSOR WITH A SELF ADDRESSED POSTPAID 2 ENVELOPE IN WHICH TO MAIL THE RECEIPT. 21 S 2.
