TITLE OF BILL : An act to amend the insurance law, in relation to authorizing insurance premium reductions for private passenger vehicles retrofitted with daytime running lamps
PURPOSE : To provide for an actuarially appropriate premium discount on auto insurance for vehicles that are retrofitted with daytime running lamps.
SUMMARY OF PROVISIONS : Amends Insurance Law section 2336(g) to provide that all private passenger automobile insurers may offer an actuarially appropriate premium discount for auto insurance coverage for motor vehicles that are retrofitted with daytime running lamps. Further, that the Superintendent, after consulting with the department of motor vehicles, shall promulgate by rule, qualifications and standards for the installation of such lamps. The purpose of establishing qualifications for the installation of retrofitted lamps is so that this equipment is properly installed.
JUSTIFICATION : Since the 1920's when motor vehicles first became commonplace on this nation's roads, the number of fatalities per mile driven has decreased dramatically because of improvements in safety features as well as better design standards. Insurance studies indicate that the use of daytime running lamps has significantly reduced multiple vehicle accidents by 23% in Sweden, 40% in Norway and 37% in Finland. This measure encourages the installation of such lamps to help lower the accident rate in New York and reduce the loss of life and property damage.

AN ACT to amend the insurance law, in relation to authorizing insurance premium reductions for private passenger vehicles retrofitted with daytime running lamps THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Subsection (g) of section 2336 of the insurance law, as added by chapter 362 of the laws of 1995, is amended to read as follows:
(g) Any schedule or rating plan for non-commercial private passenger automobile insurance shall, WITH RESPECT TO AUTOMOBILES EQUIPPED WITH FACTORY INSTALLED DAYTIME RUNNING LAMPS, AND MAY, WITH RESPECT TO AUTO MOBILES EQUIPPED WITH RETROFITTED DAYTIME RUNNING LAMPS, also provide for an actuarially appropriate reduction in premium charges for bodily injury liability, property damage liability, personal injury protection, medical payments and collision coverage [with respect to automobiles equipped with factory installed daytime running lamps (DRL)]. SUCH RETROFITTED LAMPS SHALL BE DESIGNED TO REDUCE ACCIDENTS BY INCREASING VEHICLE VISIBILITY AND MUST BE APPROVED BY THE SUPERINTENDENT. FURTHER, THE SUPERINTENDENT SHALL, AFTER CONSULTING WITH THE COMMISSIONER OF MOTOR VEHICLES, PROMULGATE BY RULE QUALIFICATIONS AND STANDARDS FOR THE INSTALLATION OR RETROFITTING OF SUCH LAMPS.
S 2. This act shall take effect on the first of January next succeed ing the date on which it shall have become a law and shall apply to all policies issued, renewed or amended on or after such date.
