AN ACT to amend the alcoholic beverage control law, in relation to hours
  of sale for on-premises consumption of alcoholic beverages at  certain
  licensed premises

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 106  of  the  alcoholic  beverage  control  law  is
amended by adding a new subdivision 5-a to read as follows:
  5-A.  NOTWITHSTANDING  THE  PROVISIONS OF PARAGRAPH (A) OF SUBDIVISION
FIVE OF THIS SECTION, NO ALCOHOLIC BEVERAGES SHALL BE SOLD, OFFERED  FOR
SALE OR GIVEN AWAY UPON AN OUTDOOR ATHLETIC STADIUM LOCATED IN THE COUN-
TY OF ERIE WITH AT LEAST SIXTY THOUSAND FIXED SEATS ON SUNDAYS FROM FOUR
ANTE  MERIDIEM  UNTIL ELEVEN ANTE MERIDIEM. PROVIDED, HOWEVER, THAT THIS
SUBDIVISION SHALL ONLY APPLY WHEN SUCH OUTDOOR ATHLETIC STADIUM IS HOST-
ING A PROFESSIONAL SPORTING EVENT.
  S 2. This act shall take effect September 1, 2014.
