Cymbrowitz) -- (at request of the Governor) -- read once and referred to the Committee on Codes AN ACT to amend the public health law, in relation to allowing certain employees of the bureau of narcotic enforcement access to criminal history information THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 3385-a to read as follows: S 3385-A. ACCESS TO CRIMINAL HISTORY INFORMATION. UPON SUCH TERMS AND CONDITIONS AS THE COMMISSIONER OF THE DIVISION OF CRIMINAL JUSTICE SERVICES AGREES, AUTHORIZED EMPLOYEES OF THE DEPARTMENT'S BUREAU OF NARCOTIC ENFORCEMENT, DESIGNATED BY THE COMMISSIONER PURSUANT TO SUBDI- VISION TWO OF SECTION THREE THOUSAND THREE HUNDRED EIGHTY-FIVE OF THIS TITLE, MAY ACCESS CRIMINAL HISTORY INFORMATION IN THE CENTRAL DATA FACILITY ESTABLISHED PURSUANT TO SUBDIVISION SIX OF SECTION EIGHT HUNDRED THIRTY-SEVEN OF THE EXECUTIVE LAW UPON REQUEST TO THE DIRECTOR OF THE BUREAU OF NARCOTIC ENFORCEMENT DEMONSTRATING THE NECESSITY FOR SUCH ACCESS AS PART OF AN IDENTIFIED, ONGOING CRIMINAL INVESTIGATION. ANY INFORMATION OBTAINED AS A RESULT OF SUCH ACCESS SHALL NOT BE DISSEM- INATED TO PERSONS NOT AUTHORIZED TO ACCESS SUCH CRIMINAL HISTORY INFOR- MATION. S 2. This act shall take effect immediately.
