BILL NUMBER:A10448 TITLE OF BILL: An act to amend Jonathan's law, in relation to release of records pertaining to allegations and investigations of abuse and mistreatment occurring on or after January 1, 2003 and before May 5, 2007 PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to ensure the intended implementation of the provisions of Chapter 321 of the Laws of 2008 governing the release of certain records to qualified persons. SUMMARY OF SPECIFIC PROVISIONS: This bill provides a two year extension requiring that requests for release of records under Jonathan's Law for incidents before May 5, 2007, now be submitted on or before December 31, 2012. JUSTIFICATION: This legislation is to extend the deadline for parents and/or qualified persons to obtain records and documents pertaining to investigations into the abuse and mistreatment of their children. PRIOR LEGISLATIVE HISTORY: Section 11 of Chapter 24 of the laws of 2007, as amended by chapter 321 of the laws of 2008; extender FISCAL IMPLICATIONS: None to the State. EFFECTIVE DATE: Immediately upon enactment.

RAIA, TOBACCO -- read once and referred to the Committee on Mental Health AN ACT to amend Jonathan's law, in relation to release of records pertaining to allegations and investigations of abuse and mistreatment occurring on or after January 1, 2003 and before May 5, 2007 THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 11 of chapter 24 of the laws of 2007, constituting Jonathan's law, as amended by chapter 321 of the laws of 2008, is amended to read as follows: S 11. This act shall take effect immediately; provided, however, that section 33.25 of the mental hygiene law as added by section two of this act shall be deemed to have been in full force and effect on and after January 1, 2003 with respect to any written requests submitted by quali- fied persons on or before December 31, [2010] 2012.
