AN ACT to amend the education law, in relation to requiring the commis sioner of education to promulgate rules and regulations requiring that all students in grade five or below remain at their school unless they are under the supervision of authorized transportation, a parent or guardian or another authorized person THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1.
Section 305 of the education law is amended by adding a new subdivision 43 to read as follows:
43. THE COMMISSIONER IS AUTHORIZED AND DIRECTED TO PROMULGATE RULES AND REGULATIONS WHICH REQUIRE THAT ALL STUDENTS WHO ARE IN GRADE FIVE OR BELOW AND WHO ARE ATTENDING SCHOOL ON A PARTICULAR DAY SHALL REMAIN AT THEIR SCHOOL BUILDING UNLESS THEY ARE RELEASED UNDER THE SUPERVISION OF AUTHORIZED TRANSPORTATION, A PARENT OR GUARDIAN OR ANOTHER AUTHORIZED PERSON.
