AN  ACT to amend the parks, recreation and historic preservation law, in
  relation to providing free use of state parks for veterans and surviv-
  ing spouses or domestic partners of those killed in combat

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  parks,  recreation  and historic preservation law is
amended by adding a new section 13.22 to read as follows:
  S 13.22 FREE USE OF STATE PARKS.   NOTWITHSTANDING THE  PROVISIONS  OF
ANY  OTHER  LAW,  ANY  PERSON  WHO  IS A RESIDENT OF NEW YORK STATE, WHO
SERVED IN THE ARMED FORCES OF THE UNITED STATES DURING A TIME OF WAR, AS
DEFINED IN PARAGRAPH (C) OF SUBDIVISION ONE OF  SECTION  EIGHTY-FIVE  OF
THE  CIVIL  SERVICE  LAW  OR THE SURVIVING SPOUSE OR DOMESTIC PARTNER OF
DECEASED MILITARY PERSONNEL WHO WERE KILLED IN COMBAT OR DUTY SUBJECT TO
HOSTILE FIRE OR IMMINENT DANGER, AS DEFINED IN 37 USC S 310(A)(4), SHALL
BE PERMITTED TO USE ANY OF THE STATE PARKS IN THIS STATE, UPON THE  SAME
TERMS  AND  CONDITIONS  AS  APPLY TO THE GENERAL PUBLIC, BUT WITHOUT THE
PAYMENT OF ANY FEES OR OTHER CHARGES FOR THE USE OF SUCH STATE PARKS.
  S 2. This act shall take effect on the one hundred twentieth day after
it shall have become a law; provided, however, that effective immediate-
ly, the addition, amendment and/or repeal  of  any  rule  or  regulation
necessary  for  the  implementation of this act on its effective date is
authorized and directed to be made  and  completed  on  or  before  such
effective date.
