AN  ACT to amend the agriculture and markets law, in relation to requir-
  ing animal dealers to disclose information about  the  disposition  of
  unwanted animals kept as pets

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The agriculture and markets law is amended by adding a  new
section 408 to read as follows:
  S 408. DISPOSITION OF ANIMALS KEPT AS PETS. 1. ANY LICENSED PET DEALER
SHALL BE REQUIRED TO PROVIDE INFORMATION TO PURCHASERS ABOUT DISPOSITION
OF  UNWANTED  ANIMALS  KEPT AS PETS. SUCH INFORMATION SHALL INCLUDE, BUT
NOT BE LIMITED TO:
  (A) A DISCLOSURE FORM THAT SHALL BE SIGNED AND DATED BY THE  PURCHASER
AND RETAINED BY THE LICENSED DEALER;
  (B)  INFORMATION  IN  THE  DEPARTMENT  OF ENVIRONMENTAL CONSERVATION'S
RULES AND REGULATIONS REGARDING THE RELEASE OF NON-NATIVE SPECIES; AND
  (C) INFORMATION ON LOCAL FACILITIES THAT CAN CARE FOR OR TAKE UNWANTED
ANIMALS.
  2. THE COMMISSIONER IN CONJUNCTION WITH THE COMMISSIONER  OF  ENVIRON-
MENTAL  CONSERVATION  SHALL DEVELOP AND MAINTAIN A MODEL DISCLOSURE FORM
AND FACT SHEET ON THE  APPLICABLE  RULES  AND  REGULATIONS  FOR  USE  BY
LICENSED  PET DEALERS. SUCH FORMS SHALL BE MADE AVAILABLE ON THE DEPART-
MENT OF ENVIRONMENTAL CONSERVATION'S WEBSITE.
  S 2. This act shall take effect on the three hundred  sixty-fifth  day
after it shall have become a law, provided, however, the commissioner of
agriculture  and markets and the commissioner of environmental conserva-
tion shall have the authority to promulgate  any  rules  or  regulations
necessary for the implementation of this act on or before such effective
date.
