AN ACT to amend the education law, in relation to requiring all certi fied teachers to attend gang awareness training once every three years
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1.
Section 3004 of the education law is amended by adding a new subdivision 7 to read as follows:
7. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THE COMMISSIONER SHALL PRESCRIBE REGULATIONS REQUIRING THAT ONCE EVERY THREE YEARS AFTER COMPLETION OF THE FIRST FULL ACADEMIC YEAR OF EMPLOYMENT AS A CERTIFIED TEACHER, ALL CERTIFIED TEACHERS SHALL ATTEND A SEMINAR, CLASS, COURSE, OR OTHER TRAINING PROGRAM RELATING TO GANG VIOLENCE AND ITS IMPACT ON SCHOOL AGE CHILDREN. THE TRAINING PROGRAM SHALL BE ADMINISTERED BY AN INSTITUTION OR PROVIDER WHICH HAS BEEN APPROVED BY THE DEPARTMENT TO PROVIDE SUCH TRAINING AND THE COMMISSIONER SHALL REQUIRE THAT APPROVED PROGRAMS PROVIDE TEACHERS WITH WRITTEN CONFIRMATION OR A "CERTIFICATE OF COMPLETION" OF THEIR ATTENDANCE AND COMPLETION OF THE PROGRAM. THE COMMISSIONER SHALL PRESCRIBE RULES OR REGULATIONS DEFINING THE PROCE DURES BY WHICH THE DEPARTMENT SHALL VERIFY ATTENDANCE AND COMPLETION OF THE PROGRAM, AND PENALTIES FOR FAILURE TO COMPLY WITH THE REQUIREMENTS OF THIS SECTION.
