AN ACT to amend the general business law, in relation to  requiring  gas
  stations  to  maintain  a backup generator to operate gas pumps in the
  event of loss of electricity

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The general business law is amended by adding a new section
399-eee to read as follows:
  S  399-EEE.  PLACEMENT OF BACKUP GENERATORS AT GAS STATIONS. 1.  EVERY
RETAIL GAS STATION LOCATED WITHIN THIS STATE SHALL BE REQUIRED TO  MAIN-
TAIN  A  BACKUP GENERATOR CAPABLE OF OPERATING ALL GAS PUMPS SITUATED ON
THE PROPERTY FOR A PERIOD OF NO LESS THAN FORTY-EIGHT HOURS IN THE EVENT
THAT THE RETAIL GAS STATION LOSES ITS MAIN SOURCE OF ELECTRICITY.
  2. FOR PURPOSES OF THIS SECTION, "RETAIL GAS  STATION"  SHALL  MEAN  A
FILLING  STATION WHERE GASOLINE IS STORED PRIMARILY FOR SALE BY DELIVERY
DIRECTLY INTO THE ORDINARY FUEL TANK CONNECTED  WITH  THE  ENGINE  OF  A
MOTOR  VEHICLE  OR  VESSEL TO BE CONSUMED IN THE OPERATION OF SUCH MOTOR
VEHICLE OR VESSEL.
  S 2. This act shall take effect on the one hundred eightieth day after
it shall have become a law.
