AN  ACT  to  amend  the  public  health  law,  in  relation to providing
  reimbursement to municipalities for certain services

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  public health law is amended by adding a new section
611 to read as follows:
  S 611. STATE AID;  OPTIONAL  SERVICES.  STATE  AID  REIMBURSEMENT  FOR
PUBLIC  HEALTH  SERVICES  PROVIDED  BY  A MUNICIPALITY UNDER THIS TITLE,
SHALL BE MADE AS FOLLOWS:
  1. IF THE MUNICIPALITY IS PROVIDING ADULT CHRONIC  CARE  SERVICES  AND
SUCH  MUNICIPALITY  IS  NOT  THE SOLE HOME HEALTH SERVICES PROVIDER AT A
RATE OF NOT LESS THAN THIRTY-SIX PER CENTUM OF THE  MONIES  EXPENDED  BY
THE  MUNICIPALITY  FOR  SUCH  SERVICES.  NO  SUCH REIMBURSEMENT SHALL BE
PROVIDED FOR SERVICES IF THEY ARE NOT APPROVED IN A PLAN OR IF  NO  PLAN
IS SUBMITTED FOR SUCH SERVICES.
  2. IF THE MUNICIPALITY PROVIDES THE FOLLOWING SERVICES:
  (A) EARLY INTERVENTION SERVICES COORDINATION;
  (B) DENTAL SERVICES;
  (C) HOME HEALTH SERVICES;
  (D) LONG TERM CARE;
  (E) EMERGENCY MEDICAL SERVICES;
  (F) ENVIRONMENTAL SERVICES;
  (G) RADIOACTIVE MATERIAL LICENSING;
  (H) EQUIPMENT LICENSING; OR
  (I) HOUSING HYGIENE;
  SUCH MUNICIPALITY SHALL BE ELIGIBLE FOR REIMBURSEMENT AT A RATE OF NOT
LESS  THAN  THIRTY-SIX  PER CENTUM OF THE MONIES EXPENDED BY THE MUNICI-
PALITY FOR SUCH SERVICES. NO SUCH REIMBURSEMENT SHALL  BE  PROVIDED  FOR
SERVICES  IF  THEY ARE NOT APPROVED IN A PLAN OR IF NO PLAN IS SUBMITTED
FOR SUCH SERVICES.
  S 2. This act shall take effect immediately.
