AN  ACT  to  amend  the  social  services  law, in relation to requiring
  employees of certain child care facilities to be trained and certified
  in cardiopulmonary resuscitation and first aid

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  390-a  of  the social services law is amended by
adding a new subdivision 6 to read as follows:
  6. THE OFFICE OF CHILDREN AND FAMILY SERVICES SHALL  PROMULGATE  REGU-
LATIONS REQUIRING OPERATORS, PROGRAM DIRECTORS, ASSISTANTS AND EMPLOYEES
WITH  THE POTENTIAL FOR REGULAR AND SUBSTANTIAL CONTACT WITH CHILDREN OF
FAMILY DAY CARE HOMES, GROUP FAMILY DAY  CARE  HOMES,  SCHOOL-AGE  CHILD
CARE  PROGRAMS  AND  CHILD  DAY  CARE CENTERS TO RECEIVE CARDIOPULMONARY
RESUSCITATION AND FIRST AID TRAINING AND CERTIFICATION.  THE  RULES  AND
REGULATIONS  SHALL  REQUIRE SUCH TRAINING AND CERTIFICATIONS TO BE MAIN-
TAINED AS CURRENT PURSUANT TO THE REQUIREMENTS ESTABLISHED BY THE AMERI-
CAN NATIONAL RED CROSS OR THE AMERICAN HEART ASSOCIATION.
  S 2. This act shall take effect on the ninetieth day  after  it  shall
have  become  a  law,  provided, however, that effective immediately the
amendment, addition, and/or repeal of any rule or  regulation  necessary
for the timely implementation of this act on its effective date is here-
by authorized and directed to be made on or before such effective date.
