AN ACT in relation to authorizing the commissioner of transportation to issue a permit exempting certain signs
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Notwithstanding the provisions of section 88 of the high way law, or any regulations adopted pursuant to such law, the commis sioner of transportation is hereby authorized to allow to continue to exist a sign located along state route three in the city of Watertown, county of Jefferson that is otherwise in conformance with the provisions of such law and regulations and constructed in reliance upon a building permit issued by such city in 2008; provided, however, that application for a permit is made to the commissioner of transportation within 180 days of the effective date of this act. Such application shall contain proof, satisfactory to the commissioner of transportation, that such sign was constructed in reliance upon such building permit.
S 2. This act shall be deemed repealed if any federal agency or any court of competent jurisdiction determines that this act would render New York state ineligible for the receipt of federal funds.
S 3. This shall take effect immediately; provided, however, that the commissioner of the department of transportation shall notify the legis lative bill drafting commission upon the occurrence of the provisions of section two of this act in order that the commission may maintain an accurate data base of the official text of the laws of the state of New York in furtherance of effecting the provisions of section 44 of the legislative law and section 70-b of the public officers law.
