AN ACT to amend the executive  law,  in  relation  to  allowing  certain
  administrative fees to be waived when the applicant is a veteran

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The executive law is amended by adding a new section 369 to
read as follows:
  S  369.  PERMIT  FEE  WAIVER  FOR  VETERANS.  1.  NOTWITHSTANDING  ANY
PROVISION OF THE LAW TO THE CONTRARY, ALL STATE AGENCIES SHALL WAIVE ANY
PERMIT  OR ADMINISTRATIVE FEE LEVIED ON A SMALL BUSINESS WHEN SUCH BUSI-
NESS IS BEING ESTABLISHED BY A VETERAN WHETHER SUCH FEE  IS  ESTABLISHED
BY STATUTE OR REGULATION, PROVIDED, HOWEVER THAT THE APPLICANT CAN PROVE
THEY  ARE A VETERAN AND THE PERMIT IS REQUIRED BY LAW FOR THE ESTABLISH-
MENT AND OPERATION OF A SMALL BUSINESS THAT THE   VETERAN WILL  OWN  AND
OPERATE.
  2.  FOR THE PURPOSE OF THIS SECTION THE FOLLOWING TERMS SHALL HAVE THE
FOLLOWING MEANINGS: "PERMIT" SHALL MEAN THE WHOLE OR PART OF  ANY  STATE
AGENCY PERMIT, LICENSE, CERTIFICATE, APPROVAL, REGISTRATION, CHARTER, OR
ANY FORM OR PERMISSION REQUIRED BY LAW, TO ENGAGE IN ACTIVITY ASSOCIATED
WITH  OR INVOLVING THE ESTABLISHMENT OF A SMALL BUSINESS IN THE STATE OF
NEW YORK; "AGENCY" SHALL MEAN ANY STATE AGENCY,  BOARD,  COMMISSION,  OR
DIVISION  THAT  REGULATES  ONE  OR MORE PROFESSIONS, OCCUPATIONS, INDUS-
TRIES, BUSINESSES, OR ACTIVITIES; "SMALL BUSINESS" SHALL MEAN A BUSINESS
WHICH IS RESIDENT IN THIS STATE, INDEPENDENTLY OWNED AND  OPERATED,  NOT
DOMINANT  IN  ITS  FIELD  AND  EMPLOYS  ONE HUNDRED OR LESS PERSONS; AND
"VETERAN" HAS THE SAME MEANING ASSIGNED TO IT IN SECTION  THREE  HUNDRED
FIFTY OF THIS CHAPTER.
  S 2. This act shall take effect immediately.
