TENNEY, FINCH -- read once and referred to the Committee on Economic Development AN ACT to amend the alcoholic beverage control law, in relation to the penalty for the illegal sale of an alcoholic beverage to a visibly intoxicated person THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 65 of the alcoholic beverage control law is amended by adding a new subdivision 8 to read as follows: 8. A VIOLATION OF THE PROVISIONS OF SUBDIVISION TWO OF THIS SECTION BY ANY PERSON ACTING UNDER THE AUTHORITY OF A LICENSE OR PERMIT TO SELL ALCOHOLIC BEVERAGES AT RETAIL FOR CONSUMPTION ON THE PREMISES SHALL BE A FELONY; PROVIDED THE AUTHORIZED SELLER KNOWINGLY SOLD ALCOHOLIC BEVERAG- ES TO A VISIBLY INTOXICATED PERSON. S 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
