AN ACT to amend the public health law, in relation  to  capping  compen-
  sation for hospital executives

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The public health law is amended by adding  a  new  section
2827 to read as follows:
  S  2827.  LIMITATION  ON  SALARY FOR HOSPITAL EXECUTIVES. 1.  NOTWITH-
STANDING ANY INCONSISTENT SECTION OF  LAW,  FOR  THE  PURPOSES  OF  THIS
SECTION:  (A)  "HOSPITAL"  SHALL  MEAN ANY HOSPITAL ORGANIZED UNDER THIS
ARTICLE THAT RECEIVES  PAYMENT  BY  PROVIDING  SERVICES  TO:  RECIPIENTS
ELIGIBLE FOR MEDICAL ASSISTANCE PURSUANT TO TITLE ELEVEN OF ARTICLE FIVE
OF  THE  SOCIAL  SERVICES LAW; ENROLLEES ELIGIBLE FOR MEDICAL ASSISTANCE
PURSUANT TO SUCH TITLE AND ENROLLED IN APPROVED MANAGED  CARE  ORGANIZA-
TIONS PURSUANT TO SECTION THREE HUNDRED SIXTY-FOUR-J OF SUCH TITLE ELEV-
EN;  ENROLLEES  ELIGIBLE FOR FAMILY HEALTH PLUS AND ENROLLED IN APPROVED
ORGANIZATIONS PURSUANT TO TITLE ELEVEN-D OF ARTICLE FIVE OF  THE  SOCIAL
SERVICES  LAW; ENROLLEES ELIGIBLE FOR THE CHILD HEALTH INSURANCE PROGRAM
AND ENROLLED IN APPROVED ORGANIZATIONS PURSUANT TO TITLE ONE-A OF  ARTI-
CLE TWENTY-FIVE OF THIS CHAPTER; AND ENROLLEES OF THE ELDERLY PHARMACEU-
TICAL INSURANCE COVERAGE PROGRAM, PURSUANT TO TITLE THREE OF ARTICLE TWO
OF THE ELDER LAW; AND
  (B)  "HOSPITAL EXECUTIVE" SHALL MEAN A PERSON OR GROUP HAVING ADMINIS-
TRATIVE OR MANAGERIAL AUTHORITY OF A HOSPITAL, WHICH SHALL INCLUDE,  BUT
NOT  BE  LIMITED  TO,  THE FOLLOWING POSITIONS: CHIEF EXECUTIVE OFFICER,
CHIEF EXECUTIVE, EXECUTIVE OFFICER, EXECUTIVE DIRECTOR, CHIEF  FINANCIAL
OFFICER,  PRESIDENT, EXECUTIVE PRESIDENT, VICE PRESIDENT, EXECUTIVE VICE
PRESIDENT, EXECUTIVE VICE  PRESIDENT-CORPORATE,  EXECUTIVE  VICE  PRESI-
DENT-OPERATIONS,  SENIOR  VICE  PRESIDENT,  AND SENIOR VICE PRESIDENT OF
FINANCE OR ANY OTHER COMPARABLE POSITION; AND

 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
