AN ACT to amend the public service law, in relation to requiring certain
  information to be filed with the department of public service

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The public service law is amended by adding a new section
121-b to read as follows:
  S 121-B. FILING OF CERTAIN INFORMATION.  1. ALL PERSONS WHO OWN AND/OR
OPERATE A GAS GATHERING LINE OR A PIPELINE FACILITY, SHALL FILE WITH THE
DEPARTMENT A REPORT DETAILING WHAT IS  BEING  TRANSPORTED  IN  SAID  GAS
GATHERING LINE OR PIPELINE FACILITY.
  2.  FOR  PURPOSES  OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE
FOLLOWING MEANINGS:
  (A) "GATHERING LINE" MEANS A  PIPELINE  THAT  TRANSPORTS  GAS  FROM  A
CURRENT PRODUCTION FACILITY TO A TRANSMISSION LINE, MAIN, OR DIRECTLY TO
AN END USER.
  (B)   "PIPELINE   FACILITY"   MEANS   NEW   AND   EXISTING   PIPELINE,
RIGHTS-OF-WAY, AND ANY RELATED EQUIPMENT, FACILITY, OR BUILDING, USED IN
THE TRANSPORTATION OF GAS, OR IN THE TREATMENT OF GAS DURING THE  COURSE
OF  TRANSPORTATION, IN CONNECTION WITH THE PRODUCTION, GATHERING, TREAT-
MENT OR PROCESSING OF SUCH GAS, BUT DOES NOT  INCLUDE  ANY:  (I)  TRANS-
MISSION AND DISTRIBUTION SYSTEM OPERATED BY A LOCAL DISTRIBUTION COMPANY
SUBJECT  TO THE JURISDICTION OF THE COMMISSION FOR PURPOSES OF PROVIDING
RETAIL UTILITY SERVICE; OR (II) TRANSMISSION PIPELINE CONSTRUCTED  BY  A
NATURAL  GAS  COMPANY UNDER THE AUTHORITY OF THE FEDERAL NATURAL GAS ACT
(15 U.S.C.A. SECTION 717 ET SEQ.).  THE DEPARTMENT SHALL HAVE THE OPTION
TO INCORPORATE ANY ADDITIONAL INFORMATION REGARDING PIPELINE FACILITIES.
  S 2. This act shall take effect on the one hundred eightieth day after
it shall have become a law, provided however, that effective  immediate-
ly,  the  addition,  amendment  and/or  repeal of any rule or regulation
necessary for the implementation of this act on its effective  date  are
authorized  and  directed  to  be  made  and completed on or before such
effective date.
