AN ACT to amend the public health law, in  relation  to  establishing  a
  state-wide database on the location and availability of medical proce-
  dures

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 1 of section 2995-b of the public health law is
amended by adding a new paragraph (d) to read as follows:
  (D)  ESTABLISH  A  STATE-WIDE  DATABASE  OF  ALL  MEDICAL   PROCEDURES
PERFORMED  IN  HOSPITALS  IN  THE  STATE.  THE  DATABASE SHALL LIST EACH
MEDICAL  PROCEDURE  AND  PROVIDE  INFORMATION  ON  WHICH  HOSPITALS  ARE
EQUIPPED TO PERFORM SUCH MEDICAL PROCEDURE.
  S  2. Section 2995-b of the public health law is amended by adding two
new subdivisions 4 and 5 to read as follows:
  4. ELECTRONIC ACCESS. THE  DEPARTMENT  SHALL  PROVIDE  FOR  ELECTRONIC
ACCESS  TO  AND  COPYING  OF HOSPITAL REPORT CARDS DEVELOPED PURSUANT TO
THIS SECTION AND MAKE SUCH INFORMATION  AVAILABLE  ON  THE  DEPARTMENT'S
WEBSITE.
  5.  RULES  AND  REGULATIONS. THE DEPARTMENT SHALL PROMULGATE ANY RULES
AND REGULATIONS NECESSARY FOR THE IMPLEMENTATION OF SUCH DATABASE ESTAB-
LISHED PURSUANT TO PARAGRAPH (D) OF SUBDIVISION ONE OF THIS SECTION.
  S 3. This act shall take effect immediately.
