AN  ACT  to  amend  the  state  finance law, in relation to creating the
  under-grounding of electrical power or telecommunications lines fund

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  state finance law is amended by adding a new section
99-u to read as follows:
  S 99-U. UNDER-GROUNDING  OF  ELECTRICAL  POWER  OR  TELECOMMUNICATIONS
LINES  FUND.  1. THERE IS HEREBY ESTABLISHED IN THE JOINT CUSTODY OF THE
STATE COMPTROLLER AND THE COMMISSIONER OF TAXATION AND FINANCE A SPECIAL
REVENUE FUND TO BE KNOWN AS THE "UNDER-GROUNDING OF ELECTRICAL POWER  OR
TELECOMMUNICATIONS LINES FUND".
  2.  THE  FUND SHALL CONSIST OF ALL MONIES APPROPRIATED FOR ITS PURPOSE
INCLUDED BUT NOT LIMITED TO ANY FUNDS SUPPLIED BY THE FEDERAL  EMERGENCY
MANAGEMENT  AGENCY FOR DISASTER RECOVERY AND HAZARD MITIGATION WHICH MAY
BE USED FOR STATE INFRASTRUCTURE REPAIR.
  3. MONIES OF THE FUND, WHEN ALLOCATED, SHALL BE DISBURSED  TO  PROVIDE
FOR  THE  PURPOSE  OF  MOVING  OVERHEAD ELECTRICAL POWER OR TELECOMMUNI-
CATIONS LINES UNDERGROUND. UNDER THE FUND COUNTIES, TOWNS  AND  VILLAGES
MAY  APPLY  FOR  REIMBURSEMENT  FROM THE FUND TO CONTRACT WITH POWER AND
TELECOMMUNICATIONS PROVIDERS AS  PROVIDED  IN  THIS  SECTION.  COUNTIES,
TOWNS  AND VILLAGES MAY SUPPLY A TWO MAN CREW AND USE OF CERTAIN PROJECT
NECESSARY EQUIPMENT TO POWER AND TELECOMMUNICATIONS  PROVIDERS  FOR  THE
PURPOSE  OF MOVING OVERHEAD ELECTRICAL POWER OR TELECOMMUNICATIONS LINES
UNDERGROUND.
  S 2. This act shall take effect immediately.
