AN ACT to amend the alcoholic beverage control law, in relation to the
penalty for the illegal sale of an alcoholic beverage to a visibly
intoxicated person
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 65 of the alcoholic beverage control law is amended
by adding a new subdivision 8 to read as follows:
8. A VIOLATION OF THE PROVISIONS OF SUBDIVISION TWO OF THIS SECTION BY
ANY PERSON ACTING UNDER THE AUTHORITY OF A LICENSE OR PERMIT TO SELL
ALCOHOLIC BEVERAGES AT RETAIL FOR CONSUMPTION ON THE PREMISES SHALL BE A
FELONY; PROVIDED THE AUTHORIZED SELLER KNOWINGLY SOLD ALCOHOLIC BEVERAG-
ES TO A VISIBLY INTOXICATED PERSON.
S 2. This act shall take effect on the first of November next succeed-
ing the date on which it shall have become a law.
