AN ACT to amend the executive law and the general business law, in
relation to the bicycle theft prevention awareness and education
program
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 3 of section 94-a of the executive law is
amended by adding a new paragraph 16 to read as follows:
(16) ESTABLISH A BICYCLE THEFT PREVENTION AWARENESS AND EDUCATION
PROGRAM PURSUANT TO SECTION THREE HUNDRED NINETY-ONE-CC OF THE GENERAL
BUSINESS LAW.
S 2. The general business law is amended by adding a new section 391-
cc to read as follows:
S 391-CC. BICYCLE THEFT PREVENTION AWARENESS AND EDUCATION PROGRAM. 1.
THE CONSUMER PROTECTION DIVISION OF THE DEPARTMENT OF STATE, HEREAFTER
REFERRED TO IN THIS SECTION AS THE "CONSUMER PROTECTION DIVISION," AND
IN CONJUNCTION WITH THE DIVISION OF STATE POLICE AND IN CONSULTATION
WITH THE NEW YORK CITY POLICE DEPARTMENT AND NEW YORK CITY DEPARTMENT OF
CONSUMER AFFAIRS, SHALL DEVELOP, IMPLEMENT, AND MAINTAIN AN ONGOING
PUBLIC AWARENESS AND EDUCATION PROGRAM TO INFORM THE GENERAL PUBLIC OF
SYSTEMS AND METHODS DESIGNED TO PREVENT BICYCLE THEFT, INCLUDING, BUT
NOT LIMITED TO, PROPER METHODS FOR PARKING AND LOCKING BICYCLES, THE
BENEFITS OF BICYCLE REGISTRATION, AND THE PROPER PROCEDURE FOR REPORTING
BICYCLE THEFT.

2. THE CONSUMER PROTECTION DIVISION SHALL PRODUCE AND DISTRIBUTE
EDUCATIONAL MATERIALS RELATED TO BICYCLE THEFT PREVENTION. SUCH MATERI-
ALS SHALL INCLUDE REFERENCE TO BICYCLE REGISTRATION PROGRAMS ADMINIS-
TERED BY MUNICIPALITIES AND OTHER APPROPRIATE ENTITIES. SUCH MATERIALS
SHALL BE MADE AVAILABLE, UPON REQUEST, TO LAW ENFORCEMENT AGENCIES,
EDUCATION INSTITUTIONS, COMMUNITY GROUPS, AND MUNICIPALITIES. THE
CONSUMER PROTECTION DIVISION SHALL ALSO POST OR CAUSE TO BE POSTED THE
CONTENTS OF SUCH EDUCATIONAL MATERIALS ON THE DIVISION'S INTERNET
WEBSITE.
3. THE CONSUMER PROTECTION DIVISION SHALL PERIODICALLY REVIEW AVAIL-
ABLE DATA ON BICYCLE THEFT AND UPDATE THE INFORMATION ON BICYCLE THEFT
PREVENTION AWARENESS PROVIDED IN ITS EDUCATIONAL MATERIALS AND ON ITS
INTERNET WEBSITE, AS APPROPRIATE.
4. THE CONSUMER PROTECTION DIVISION SHALL ISSUE A WRITTEN REPORT, ON
OR BEFORE APRIL FIRST NEXT SUCCEEDING THE DATE ON WHICH THIS SECTION
SHALL HAVE BECOME A LAW TO THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE
SENATE AND THE SPEAKER OF THE ASSEMBLY ON THE IMPLEMENTATION OF THIS
SECTION AND ANY RECOMMENDATIONS FOR FURTHERING THE PURPOSE OF THIS
SECTION.
S 3. This act shall take effect immediately.
