AN ACT to amend the education law, in relation to  the  distribution  of
  aid for high cost students with disabilities

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 3609-b of the education law is amended by adding  a
new third undesignated paragraph to read as follows:
  FOR  AID  PAYABLE  IN  THE  TWO THOUSAND FIFTEEN--TWO THOUSAND SIXTEEN
SCHOOL YEAR AND THEREAFTER, "MONEYS APPORTIONED" SHALL MEAN CURRENT YEAR
AID PROVIDED FOR CURRENT YEAR EXPENSES FOR NEW HIGH COST  STUDENTS  WITH
DISABILITIES  THAT MOVE INTO THE DISTRICT DURING THE SCHOOL YEAR WITH AN
INDIVIDUALIZED EDUCATION PROGRAM FROM A COMMITTEE ON  SPECIAL  EDUCATION
OF ANOTHER SCHOOL DISTRICT.
  S  2.  Paragraph  c  of subdivision 3 of section 4405 of the education
law, as amended by chapter 82 of the laws of 1995, is amended to read as
follows:
  c. The apportionments to each school district pursuant to this  subdi-
vision shall be based on excess cost paid and attendance during the base
year EXCEPT, BEGINNING IN THE TWO THOUSAND FIFTEEN--TWO THOUSAND SIXTEEN
SCHOOL  YEAR  AND  THEREAFTER,  "MONEYS  APPORTIONED"  SHALL BE BASED ON
EXCESS COST PAID AND ATTENDANCE DURING THE CURRENT YEAR FOR NEW STUDENTS
WITH DISABILITIES THAT MOVE INTO THE DISTRICT  DURING  THE  SCHOOL  YEAR
WITH  AN  INDIVIDUALIZED  EDUCATION  PROGRAM FROM A COMMITTEE ON SPECIAL
EDUCATION OF ANOTHER SCHOOL DISTRICT REQUIRING  ATTENDANCE  AT  APPROVED
PRIVATE SPECIAL EDUCATION PROGRAMS.
  S  3.  This act shall take effect on the first of July next succeeding
the date on which it shall have become a law.
