AN ACT to amend the public health law, in relation to  establishing  the
  Lake  Placid  part-time  off-campus emergency department demonstration
  program; and providing for the repeal of such provisions upon  expira-
  tion thereof

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The public health law is amended by adding  a  new  section
2805-w to read as follows:
  S 2805-W. LAKE PLACID PART-TIME OFF-CAMPUS EMERGENCY DEPARTMENT DEMON-
STRATION  PROGRAM. 1. NOTWITHSTANDING ANY INCONSISTENT PROVISION OF LAW,
RULE OR REGULATION, THE COMMISSIONER SHALL AUTHORIZE ADIRONDACK  MEDICAL
CENTER  TO  OPERATE  ITS  CURRENT EMERGENCY DEPARTMENT AT THE ADIRONDACK
MEDICAL CENTER IN THE VILLAGE OF LAKE PLACID,  COUNTY  OF  ESSEX,  AS  A
PART-TIME  OFF-CAMPUS  EMERGENCY  DEPARTMENT DEMONSTRATION IN ACCORDANCE
WITH THE PROVISIONS OF THIS SECTION.
  2. SUCH OFF-CAMPUS EMERGENCY DEPARTMENT SHALL OPERATE AT LEAST  TWELVE
HOURS A DAY, EACH DAY OF THE YEAR.
  3.  SUCH  EMERGENCY DEPARTMENT SHALL MEET THE REQUIREMENTS ESTABLISHED
BY THE FEDERAL CENTERS FOR MEDICARE AND MEDICAID SERVICES FOR  A  PROVI-
DER-BASED  OFF-CAMPUS EMERGENCY DEPARTMENT AS WELL AS THOSE REQUIREMENTS
ESTABLISHED BY THE  COMMISSIONER  FOR  EMERGENCY  SERVICES  PROVIDED  BY
GENERAL  HOSPITALS; PROVIDED HOWEVER, THE COMMISSIONER SHALL WAIVE THOSE
REQUIREMENTS  THAT  CANNOT  REASONABLY  BE  APPLIED  TO  AN   OFF-CAMPUS
PART-TIME EMERGENCY DEPARTMENT.
  4.  THE  COMMISSIONER  SHALL,  WITHIN EIGHTEEN MONTHS OF THE EFFECTIVE
DATE OF THIS SECTION, SUBMIT A REPORT TO THE GOVERNOR AND  THE  LEGISLA-
TURE  ON  THE  SERVICES  PROVIDED  BY THE PART-TIME OFF-CAMPUS EMERGENCY
DEPARTMENT  AUTHORIZED  BY  THIS  SECTION,  THE  EFFECTIVENESS  OF  SUCH
SERVICES  IN  PROVIDING CARE TO RESIDENTS OF AND VISITORS TO LAKE PLACID
