AN ACT to amend the public officers law, in relation to personally iden-
  tifiable information and certain researchers; and to amend the  public
  health law, in relation to unlawful interference with research labora-
  tory operations

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 2 of section 87 of the public officers  law  is
amended by adding a new paragraph (m) to read as follows:
  (M)  ARE  RECORDS CONCERNING RESEARCH, INCLUDING ACTUAL RESEARCH DOCU-
MENTS, CONDUCTED UNDER THE AUSPICES OF A RESEARCH  LABORATORY,  AS  THAT
TERM  IS  DEFINED  IN SECTION FIVE HUNDRED SIX OF THE PUBLIC HEALTH LAW,
THAT CONTAIN PERSONALLY IDENTIFIABLE INFORMATION  OR  OTHER  INFORMATION
NOT GENERALLY AVAILABLE TO THE GENERAL PUBLIC.
  S 2. Subdivision 2 of section 96 of the public officers law is amended
by adding a new paragraph (e) to read as follows:
  (E)  PERSONAL  INFORMATION  OR OTHER INFORMATION THAT IS NOT GENERALLY
AVAILABLE TO THE PUBLIC RELATING TO RESEARCH  CONDUCTED  AT  A  RESEARCH
LABORATORY  AS  THAT  TERM IS DEFINED IN SECTION FIVE HUNDRED SIX OF THE
PUBLIC HEALTH LAW.
  S 3. The public health law is amended by adding a new section  506  to
read as follows:
  S  506.  UNLAWFUL INTERFERENCE WITH RESEARCH LABORATORY OPERATIONS. 1.
DEFINITIONS. FOR THE PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL
HAVE THE FOLLOWING MEANINGS:
  (A) "RESEARCH LABORATORY" MEANS ANY BUILDING,  STRUCTURE,  LABORATORY,
VEHICLE,  PASTURE,  PADDOCK,  POND,  IMPOUNDMENT  OR  PREMISES REGULATED
PURSUANT TO THIS ARTICLE AT WHICH LEGAL BIOMEDICAL RESEARCH OR  TEACHING
IS  CONDUCTED  OR  ATTEMPTED  OR  WHERE RECORDS OR DOCUMENTS RELATING TO
EXPERIMENTS, PRODUCTION, EDUCATION OR INVESTIGATION ARE MAINTAINED.

SECURITY OF A RESEARCH LABORATORY, ITS EMPLOYEES, OR FAMILY  MEMBERS  OF
ITS EMPLOYEES.
  S  2.  The public health law is amended by adding a new section 506 to
read as follows:
  S 506. UNLAWFUL INTERFERENCE WITH RESEARCH LABORATORY  OPERATIONS.  1.

AN ACT to amend the public health law, in relation to unlawful interfer-
  ence with research laboratory operations

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  public health law is amended by adding a new section
506 to read as follows:
  S 506. UNLAWFUL INTERFERENCE WITH RESEARCH LABORATORY  OPERATIONS.  AN
AGENCY  AS  DEFINED  IN  SUBDIVISION  THREE OF SECTION EIGHTY-SIX OF THE
PUBLIC OFFICERS LAW MAY DENY  ACCESS  TO  RECORDS  OR  PORTIONS  THEREOF
CONCERNING  BIOMEDICAL  RESEARCH  OR BIOMEDICAL TEACHING CONDUCTED AT AN
INSTITUTION OF  HIGHER  EDUCATION  AUTHORIZED  BY  THE  STATE  EDUCATION
DEPARTMENT  OR AT AN INSTITUTION WITHIN THE STATE THAT RECEIVES STATE OR
FEDERAL FUNDING TO CONDUCT SUCH BIOMEDICAL RESEARCH OR  SUCH  BIOMEDICAL
TEACHING  THAT,  IF  DISCLOSED, COULD ENDANGER THE LIFE OR SAFETY OF ANY
PERSON OR WOULD BE REASONABLY LIKELY TO ENDANGER THE  SECURITY  OF  SUCH
BIOMEDICAL RESEARCH LABORATORY.
  S 2. This act shall take effect immediately.
