Requires the state to pay down the gap elimination adjustment; such gap elimination adjustment for the 2014-2015 school year shall equal 50% and the gap for fiscally distressed districts shall equal zero; the gap elimination for the 2015-2016 school year shall equal zero.

IN  ASSEMBLY  -- Introduced by M. of A. THIELE -- read once and referred

AN ACT to amend the education law, in relation to requiring the state to
  pay down the gap elimination adjustment

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision  17  of  section 3602 of the education law is
amended by adding two new paragraphs g and h to read as follows:
  G. NOTWITHSTANDING ANY OTHER LAW TO THE CONTRARY, THE GAP  ELIMINATION
ADJUSTMENT  FOR  THE  TWO THOUSAND FOURTEEN--TWO THOUSAND FIFTEEN SCHOOL
YEAR SHALL EQUAL FIFTY PERCENT (0.50) OF THE GAP ELIMINATION  ADJUSTMENT
FOR  SUCH  DISTRICT  FOR  THE  TWO  THOUSAND THIRTEEN--THOUSAND FOURTEEN
SCHOOL YEAR, EXCEPT FOR SCHOOL DISTRICTS WHICH HAVE BEEN  DESIGNATED  BY
THE STATE COMPTROLLER AS FISCALLY DISTRESSED FOR CALENDAR YEAR TWO THOU-
SAND  THIRTEEN.  FOR  SUCH  FISCALLY DISTRESSED SCHOOL DISTRICTS THE GAP
ELIMINATION ADJUSTMENT SHALL BE ZERO.
  H. NOTWITHSTANDING ANY OTHER LAW TO THE CONTRARY, THE GAP  ELIMINATION
ADJUSTMENT  FOR  THE  TWO  THOUSAND FIFTEEN--TWO THOUSAND SIXTEEN SCHOOL
YEAR SHALL EQUAL ZERO.
  S 2. This act shall take effect April 1, 2014.
